Summar~r: This report is subniLtted by Panel D in response to a directive
of the Board. It submits the report in the form of a memorandum
for thE~ ~ecutive Secretary oi' the ?~Tatiotia.l Security Council forwarding a
letter, for the Presid.ent's s'C,F;nature, to the departmental heads with a
memorandum enclosure setting i'orth -the basic cautions with respect to
public statements on certain ~~rican wee.pons.
Tf~b C has been reviewed by the Staff and appears to lack a certain
degree of definitiveness--affisma.tive guidance. In its present form it
appear;; to be an "empty capsul_e." The difficu)_ty in enumerating a series
of "do's" and "don'ts" is unde:rstandable, and the Panel reports its exclu-
sion oi' such a list. Nonetheless, amore affirmative definitive tone could
be set forth in Tab C which could be bas3_cally considered guidance. Z#,
however, the Board believes that this paler will serve as a restraining
i_nstrunient upon our officials w3.th respect to public utterances on this
subject, then, the i.ntent,ratr:er than the guidance purposes for which it
is drafted, may well be served.
The Panel concludes that existing procedures are adequate and new
clearance machinery is not required; however, the committee is to remain
subject to the Ball of the chairman for ;oeriodic revision of this guidance.
Recommendation: Inasmuch as the intent cf this item is to place restraint
upon statement'rs by public officials with respect to this si7bject,
