Approved For Release 2003/04/24: CIA-RDP80BO1676R000800090028-7 DEPARTMENT OF STATE THE DIRECTOR OF INTELLIGENCE AND RESEARCH WASHINGTON SECRET May 31, 1961 You will recall that on April 11th the Intelligence Board discussed the Department of State's request that it be authorized to make certain NIEs and SNIEs available under carefully controlled conditions to selected staff members of the Institute for Defense Analysis (IDA). As you know, IDA is now preparing a comprehensive study for the Disarmament Administration of the impact on our national security of various arms control measures, proposals for disarmament, or actions to reduce the possibility or limit the dangers of war. This study is due to be completed on June 30th. The Intelligence Board agreed at that time that the Department could provide oral briefings on certain NIEs to cleared IDA staff members having a need to know. The Board also agreed that it would, at a later date, review its policies regarding the release of estimates to contractors. Please consider this to be a request for such a review. I would hope we could take this matter up at an early meeting of the Intelligence Board, say on June 6th. As a point of departure for this review, I offer the following proposal: 1. The Intelligence Board should amend USIB-D-39.5/2 of 11/10/59, "Policy Statement on Release of Intelligence to Contractors of USIB Organizations." 2. Intelligence agencies should henceforth be authorized, on their own initiative to release NIEs and SNIEs to intelligence contractors without the need to obtain prior permission of the Intelligence Board and Member agencies. 3. This authorization is designed to cover all Estimates up to and including Top Secret; it excludes, however, all Estimates which contain specially sensitive data referred to in No. 3, item j (3, 8, 9) of Attachment B to USIB-D-39.5/2. The following special control procedures will apply to releases of this kind. They are in addition to and complement those already specified in Item 3 of USIB D-39.5/2, Attachment B. a. Estimates will at all times remain within the physical custody of the Member agency. Release will take the form of visual disclosure whereby properly cleared contractor personnel may, on a demonstrated "need to know" basis, read Estimates in Member agency offices. b. Contractors may not cite NIEs or SNIEs as the source of data so obtained in any of their studies or reports. Data of this kind will be attributed only to the Member agency concerned. The determination of the particular "need to know" is, of course, an important aspect of the release in this manner of data contained in Estimates. .I believe that in the present instance, as in similar cases which may confront other Member agencies, the need to know is clearly evident. IDA's study is an important element in an across-the-board policy assessment of the highest national priority. An amendment of this kind would greatly facilitate the task at hand and in the future.
