Res. 403, a copy of which is enclosed herewith, has been passed by the House authorizing a Select Committee to investigate the operations, etc. of the Export Control Act of 1949 and related Acts. More detailed information concerning the authority of the Committee may be found by reference to the attached copy of resolution. Our Committee anticipates that on or about October 23, 1961, we will begin hearings and at the outset of such hearings, we are extending to you an invitation to appear before the Committee in Executive Session and discuss such matters as you deem pertinent to this inquiry. I would suggest that you may desire to discuss the policy of your Depart- ment and the general policy of the Administration with regard to the export of strategic items to the Sino-Soviet bloc. It is recognized that this general subject of trade with so-called Communist nations is a matter in which we are all intensely interested, particularly at this time. With this in mind, our inquiries will not be such as to create any conflict of interest between the Executive and Legislative branches of our Government, and is aimed particularly at making such suggestions and recommendations that can be implemented administratively or legislatively that may be helpful in the operation and control of this type of export. I have asked Mr. Fred Hallford, Staff Director of the Committee, to call upon you at an early date and be in position to make such arrange- ments as you desire to make as to the time and date that you could appear before the Committee in the event you desire to be heard. We will make every effort to meet your convenience but would respectfully request that a date be established the first part of the week of October 23rd so that we can conclude our hearings at the "Secretary level" early in the week with as little inconvenience to those involved as possible. In carrying out such investi , gation and study, the, committee shall give particular atten- tion to the following matters: (1) The problems involved in the control of trade between the United States and foreign countries, particularly the foreign countries comprising the Sino-Soviet bloc. (2) Present methods and procedures in the formulation of policy with respect to the determination of which articles, materials, supplies, and technical data shall be controlled under such Act, and the extent of such control. (3) Procedures followed under such Act in obtaining. information, advice, and opinions with respect to determinar 15 tions of which articles, materials, supplies, and technical data 16 shall be controlled under. such Act, from departments and 17. agencies of the United States which are concerned with 18 aspects of our domestic or foreign policies and operations 19 which have a bearing on exports. 20 (4)., The extent to which decisions heretofore,, made 21 under such Act concerning the control of exports, have 22 . adversely affected the security of the United States. 23 (5 )? , Whether or not such Act is being administered by 24 the, appropriate department; of the Federal. For the purpose of carrying out this resolution the. com- mittee or subcommittee is authorized to it and act during the present Congress at such times and places within the United States, including any territory, Commonwealth, -or possession thereof, or elsewhere, whether the -House is in. session, has recessed, or has adjourned, to hold such hearings, and to require, by subpena or otherwise, the attendance and testimony of such witnesses and the production of such books, records, correspondence, memorandums, papers, and docu- ments, as it deems necessary; except that neither the corn- mittee nor any subcommittee thereof may sit while the 18 House is meeting unless special leave to sit shall have been 19 obtau-ed from the House.
