MEMORANDUM FOR: General Counsel
SUBJECT . Your Draft Compilation, "FUNCTIONS OF THE AGENCY",
Circulated Under Buckslip Dated 23 April 1975
1. As I told you this morning, I strongly object to the
subject paper, both in terms of form and content, for the purpose
of serving "as a foundaticn for a new Agency Charter."
2. One of my primary objections is that it treats with the
functions of each of the Directorates, but does not even discuss
the functions and responsibilities of the Director of Central
Intelligence. (Incidentally, the same criticism can be made
to a large extent about the existing legislation.) But, without
a statement of the Director's responsibilities and functions,
any Charter on the CIA will be hollow and without focus. The
functions and responsibilities of all of the Directorates really
derive from those of the DCI and only in this context do they
begin to make sense. On this basis I recommend that your draft
be completely recast with an effort to show how each of the
functions of the various Directorates derive from those of the
DCI.
3. The other primary objection is that most of the paper
itself is devoted to activities which have been attacked from one
or another quarter as being improper or not in keeping with the
American spirit. Out of over 100 lines of text, less than 10
are devoted to the production of intelligence. There is no ex-
plicit statement that most of the activities enumerated are for
the purpose of providing authoritative information and assessments
about what's going on abroad to US officials who need this infor-
mation to formulate and implement US national security policy,
broadly defined.
