SUBJECT:: Draft Legislation
i. Yau will. separately receive.a.copy of.my Memorandum
far the Record of the meeting between the Vice President,
Senator Inouye and myself. As a result of this we urgently
need to review the draft legislation which Senator Huddles tan's
Subcommittee has drawn up with regard to the charter of the
CIA and the DCI and begin negotiations with that Subcommittee
towards full agreement.
2. I suggest that Walt Elder disseminate the draft to
the members of the NFIB for their comments, but that in the
meantimEy we have a joint D/DCI/IC and DDCI effort to crash
out a priority listing of necessary. revisions. With this
we shou'Id have a plan of action as to who should negotiate
these suggested changes, first with the staff and secondly
with thE~ Senators .

1. Senator Inouye reported on the following on-gaing
activities of his Committee:
a. Budget: Senator agreed to provide two
budget figures to Senator Muskie's Congressional
Budget Committee. One of these was the National
.Intelligence Budget/Related Activities .and the

voted not to provide information to Representative
Stokes in connection with the Sprague Subcommittee
on Assassinations.

On the timing question the Senator noted that
Senate Resolution 400 has a deadline of 1 July.
The Vice President made the point that we need some
time to get our study gaing.
d. Senator Bayh's Committee an Civil Rights has
a new bill on electronic surveillance of which we
should have a copy (~'). This is something that
must be worked out with the Attorney General.

to Senator McGovern in response to his letter of 29 October
that ~~hey do not want to conduct an investi ation of
alleged past mispractices of the CIA
2. ThE~ Vice President agreed to meet with Senator Nuddlestan
in the near term to discuss the timing of the charter revision
legislation. He also discussed at considerable length the
Executive Branch's desire to reduce the dissemination within the
Executive Branch and also within the Congress without covering their
need for oversight. There was a discussion of the fact that there
were certain kinds of intelligence, like names of agents and assets,
which did not need to be disclosed to the Committee.
3. On ;he question of numbers of people in the Congress to
be informed, there was a discussion of the desirability of estab-
lishing a joint committee. Senator Inouye indicated that within
the Senate tFae Select Committee is beginning to have almost exclusive
jurisdiction as the Armed Services Committee, in particular, is
no longer as active as it was. The Senator believes the House
should establish its own select committee first and after some

periocl of trial, there might be an opportunity to have jaint

Sec. 1~~. The review of proposals far, and the conduct
of, spE~cial activities in support of national foreign. policy
objectives a.nd sensitive clandestine collection projects.
(1) Special activities in scapport of national roreign
policy. objectives are to be reserved for extraordinary
eircumsta.nces when there are grave threats to the national
,security of the United States and when the overt'means avail-

able to the U. S. Government would not allow the successful
accomplishment o~ national foreign palicy objectives.
(2;) Special activities in support of national. foreign
policy objectives must be consistent with publicly defined
U. S. fo_~?eign palicy goals .
(3;i A special committee of the National Security
Council [hereinafter referred to as the Policy Review
Committee (PRG) ] shall be established to revieta special
activities in support of national foreign palicy objectives
and sensitive clandestine collection .projects. ~-For purposes
of this section, the term "sensitive clandestine collection
project". means any secret intelligence collection activity
which if discovered ar revealed mi.~~ht cause harm or embarras-
sment to the United States or adverse reaction from other
countries.) The PRC shall consist of (A) the Director
of National Intelligence, (B) the Secretary of State, (C) the
Secretary of Defense, (D) the Special. Assistant to the
