The Board recommended the approval of the request for voluntary retirement, on the date shown below, received from the following participant: 31 October. 1971 2. The Board recommended approval of the recommendation for involuntary retirement, on the date shown below, for the following par- ticipant: 25X1A9a - 31 October 1971 3. The Board next considered the nomination of Mr. Brian T. for participation in CIARDS bas&d?on 60 months of domestic qualifying service. requested that his service from 1956 25X1 A9a .until 1967, while assigned with the Office of Security 5X1A6a and from 1967 until the present, while assig^hed as Chief of Securit Staff for an OSP Project, be credited as qualifying service. X1A9a memorandum outlined in considerable detail the duties w is he per orm- ed on both of these assi nments. Listed below is a chronology of corre- spondence regarding retirement: 25X1 A9a a. In February 1966 a memorandum was forwarded to informing him of his non-eligibility for designation as a participant in CIARDS. In April 1966 a memorandum was forwarded to the Office of 25X1A6a Security from the Office which requested that four 25X1A9a employees, including be reviewed for participation in CIARDS based on domestic qualifying service. (Action on this request was delayed by the Office of Security pending a decision on a test case, which was resolved in September 1966) c. On 5 August 1966 initialed a copy of a memorandum which advised him that he would be expected to retire in September 1971, at age 62. 25X1A9a A. An internal Office of Security memorandum, dated 1 November 1968, recommended that action be taken on the designation of Mr. for participation in CIARDS. e. A hand-written note on the above memorandum, dated 20 March 1969, stated that had seen the retirement people and did not wish his request processed. 25X1 A9a f. On 23 September 1971 submitted a memorandum requesting that he be designated as a participant'in CIARDS. Board Recommendation 25X1A9a The Board recommended that NOT be approved for participation in the CIA Retirement and Disability System. In discussing this case the Board noted that a request for consideration for participation 25X1A9a had been submitted in 1966, however, had taken no further initiative to pursue this request. The Board further noted that subject is 62 years of age, two years beyond the maximun age specified by the regula- tion for designation as a participant, and has therefore had the advantage of two years of additional salary beyond the'?date which he would have been required to retire had he been approved for participation in 1966 when he first submitted his appeal. Also this additional time will provide him with an additional four percent factor for annuity icomputation and with a higher high-three average salary as a base. The Board also noted that regarding the age 60 rule, the burden is on the applicant to submit extenuating circum- 9 25X1A a stances to warrant deviation from the rule, and that .does not contain such extenuating circumstances. appeal The Board concluded that the domestic service performed since June25X1A 1967 is not qualifying under any of the provisions of 25X1A9a Board further concluded that, although SE,CRE1' Approved For Release 2001/08/02 : CIA-RDP78-03092A000900130001=5 SECRET Apprbved For Release 2001/08/02 : CIA-RDP78-03092A000900130001-5 periods of domestic service which were qualifying, they could not find that five years of the time from 1956 to 1967 were qualifying under the provisions The Chairman instructed the Executive Secretary to send the customary notice of tentative conclusion as required 4.
