SUBJECT: Briefing of the Senate Judiciary Committee and the
House Judiciary Subcommittee on Immigration,
Citizenship, and International Law, 22 April 1975
1. Accompanied I I OCI, to a briefing of the
Senate Judiciary Committee and t e House Judiciary Subcommittee
on Immigration, Citizenship, and International Law, as part of
Ambassador Brown's task force on evacuation. from Vietnam.
2. Senate- I I briefing was extremely well
received and all staff members, except for Dale DeHa n, Counsel,
Senate Subcommittee on Refugees and Escapees, were expelled from
the briefing by Chairman James Eastland (D., Miss.) and Ranking
Minority Member Roman L. Hruska (R., Neb.) on the basis "that
this is a secret CIA briefing. " Members in attendance were:
Chairman Eastland, Senators Roman Hruska (R., Neb.), Hugh Scott
(R., Pa. ), Hiram Fong (R. , Hawaii), William Scott (R., Va.),
Birch Bayh (D. , Ind. ), John Tunney (D. , Calif. ), Philip Hart (D. , Mich. ),
James Abourezk (D., S. Dak.), Strom Thurmond (R., S. C.), and Quentin
Burdick (D., N. Dak. ). The hearing was in executive session and no
transcript was taken. F ollowing briefing, Leonard F.
Chapman, Commissioner, immigration an Naturalization Service,
discussed the evacuation program assisted by State, Justice, and
Defense officials. Attorney General Levi's letter of consultation
addressed to Chairman Eastland on the categories and numbers of
individuals to qualify for immediate parole was unanimously endorsed
by the Committee.
3. House - A similar session was held with the House Subcommittee
where briefing was again very well received with
Representative Elizabeth Holtzman (D., N. Y.) raising a number of
questions. Before the session, Mrs. Holtzman questioned the necessity
for maintaining secret the information to be received. Following the
meeting, all other members were in agreement that the information was
to remain secret and that it only could be published through action of
the vote of the Subcommittee, not by an individual member. No transcript

was taken in the House session which was characterized as a "briefing"
not a hearing. Members in attendance from the House were: Chairman
Joshua Eilberg (D., Pa.), Representatives Christopher J. Dodd (D., Conn.),
Martin Russo (D., Ill.), Paul Sarbanes (D., Md. ), Elizabeth. Holtzman
(D. , N. Y. ), and William Cohen (R. , Maine).
4. The members of the Committees as well as the task force
expressed appreciation for the information provided by CIA.. (There
was a leak attributed to the Senate Committee in the Washington. Post
which stated that: "A Senate source, who attended a Central Intelligence
Agency briefing yesterday, said senators were told that it will be "a
matter of days" until Vietnam falls, "

Edward M. Kennedy's (D., Mass.) Subcommittee on Administrative Practices
and Procedures. He said he had already noted the bills and would be glad to
review them with Agency interests in mind, and added that he would surely
help if he could. He suggested I talk to Gary Clary, Senator Strom Thurmond's
(R., S. C.) man on Judiciary affairs as well.

26. (Unclassified - WPB) Talked to Gary Clary, who handles
Senator Strom Thurmond' s (R. , S. C.) -T-44 - - - C r, ,-,- ,1.4--n- ratters,
about S. 1210 and S. 1289. He said he was keenly aware of the problems
they would cause in general and in particular for the Agency. He
concluded by saying that we should feel free to enlist his help in dealing
with this legislation or in handling Agency interests within the Judiciary
Committee.
