to comment on a portion of our prepared testimony on S. 2515 (testing on
human subjects), which we had forwarded to him earlier in the day. He
requested that we maize our support for a Commission more conditional
in view of the fact that HEW was opposing the creation of the Commission
proposed in S. 2515.

He gave me some additional documents that he wanted declassified for
the hearings. These were given to Ito handle.

Subcommittee and I felt we had adequately covered the points which. he raised
in slightly different words. After going over these items individually,
Stimpson agreed but made it clear that we should not take a position with
the Subcommittee ? which would be construed as support for Chairman Edward M.
Kennedy's (D. , Mass.) bill, S. 2515.

pressing us very hard to declassify several documents including IG reports
which we felt we could not make public. I told Simpson I thought he might a
want to advise Senator Eastland who is Chairman of. the. full Judiciary
Committee, of this development. Simpson said he was glad I called him
about this and hoped I would call on him in any other similar circumstance
in the future. He said it sounded as if we had. been most reasonable in
our efforts to cooperate with the Kennedy Subcommittees and as he
put it "enough is enough.
17. I I LIAISON During the course of the
evening I received numerous calls from Thomas Susrnan, James Michie
and Walter Sheridan (Senate Judiciar Subcom i t e on Administr'
Practice and Procedure .fin Dr. Larry Horowitz (Senate Committee on
Labor and Public Welfare Subcommittee on Health), regarding tomorrow's
testimony. They were pressing for the release of various documents and
specifically the release of the IG report of 1963 on the drug program or
pertinent parts thereof. I told them we had discussed this matter with the
Director and he felt that while we had been perfectly willing to provide
these reports to the Subcommittees and to the staff in classified form,
he had serious reservations about making these documents public since
this would destroy the effectiveness of a vital means of communication
between employees of the Agency and the IG and between the I.G and. the
Director. The staffers said Senator Kennedy had discussed his interest
in the release of these documents with various members of the Subcommittees
who supported him in his position and that we could expect a strong position
from the Subcommittees on this issue tomorrow. They said further that
they would be meeting with Kennedy at his homy; tonight and the Director
might expect a call from the Senator later in the evening.

Lippencott, DOD Legislative Affairs, who was at that moment in the
offices of the Senate Judiciary Subcommittee on Administrative Practice
and procedure, and told hhimofof our position with regard to IG reports.
Lippencott said he was glad to know this, that their IG reports were
Official Use Only but they also plan to object to the release of these
reports to the public.
