SECRET 14 February 1973 MEMORANDUM FOR: Director of Central Intelligence Request of Joint Committee on Atomic Energy for NIE 11-14 (Warsaw Pact Forces for Operations in Eurasia) 1. Several weeks ago Ed Bauser, Executive Director of the Joint Committee, asked that NIE 11-14 be made available to the Committee staff in connection with a study in which they were then engaged. This Estimate (copy attached) deals with such atomic energy matters as "Nuclear Warhead Storage in Eastern Europe, " "Nuclear War in Europe, " "Low-Yield Tactical Nuclear Weapons, " and "Nuclear Support of Soviet Theater Force. " I believe these sections contain sufficient information of interest to the Committee to fall within the meaning of those provisions of the Atomic Energy Act requiring that such material be provided the Committee on request. 2. Commenting on the problem John Huizenga notes that "Is it impossible to satisfy the Joint Committee's request by excerpting the few passages which deal with nuclear weapons? If we provide materials going well beyond the Committee's charter-in effect acknowledge a claim to all NIEs on military subject matter-we have little basis for refusing the same documents to other committees. " 4. Ed Proctor comments that "Although I see no substantive problem with complying with the request, I share Huizenga's concern that this may open the door to requests for all military estimates. As I understand the law, we cannot refuse the request. I feel that sending only the nuclear parts of the estimate would cause more problems than it is worth. " 5. My judgment is that, if pressed, we could ill-afford to refuse the Committee's request. Therefore, we plan to take no action unless you direct otherwise, but I thought you should be aware of the above facts in the event Bauser or some Committee member should raise them with you.
