Calendar No. 1622 90TH CONGRESS SENATE REPORT fd Session No. 1621 CODIFICATION OF TITLE 44, UNITED STATES CODE OCTOBER 9, 1968.=Ordered to be printed Mr. ERVIN, from the Committee on the Judiciary, submitted the following REPORT The Committee on the Judiciary, to which was referred the bill, (H.R. 18612) to enact title 44, United States Code, "Public Printing and Documents," codifying the general and permanent laws relating to public printing and documents, having considered the same, reports favorably thereon without amendment and recommends that the bill do pass. PURPOSE OF THE BILL The purpose of this bill is to restate in comprehensive form, without substantive change, the statutes in effect on January 14, 1968, relating to public printing and documents, and to enact title 44, United States Code. In the revised title, simplified language is substituted for awk- ward and obsolete terms, and superseded, executed, and obsolete statutes are eliminated. This bill is a part of the program of the Com- mittee on the Judiciary of the House of Representatives to enact all 50 titles of the United States Code. STATEMENT The purpose of this legislation is to continue the codification of all of the titles of the United States Code. HISTORY The statutes relating to public printing and documents were con- solidated during the third session of the 53d Congress, in the Printing Act of 1895. Since that time many laws have been enacted affecting that statute, although not uniformly amending it, with the result that the body of printing laws has grown haphazardly. 98-910-68-1 Approved For Release 2002/06/10 : CIA-RDP72-0045OR000100090005-8 Approved For Release 2002/06/10 : CIA-RDP72-0045OR000100090005-8 2 luring the first session of the 90th Congress, the Committee on the Judiciary decided to prepare a codification of those laws, to be enacted as title 44, United States Code. The chairman of the Joint Committee on Printing, Senator Carl Hayden, and the Public Printer, Mr. James Harrison, graciously offered their cooperation in this endeavor. A bill was drafted under the direction of this committee's law revision counsel, Dr. Charles J. Zinn, with the full cooperation and assistance of the Joint Committee and the Government Printing Office. This committee expressed its deep appreciation of their cooperation and assistance and that of Mr. John Haley, staff director, and Mr. Louis Anderson, of the staff of the Joint Committee. A bill, H.R. 14144, to accomplish the codification was introduced by Mr. Willis on November 22, 1967. The committee invited an expres- sion of views from the departments and agencies interested in the title, as well as the Joint Committee on Printing. Thereafter, upon receipt of such views, a complete review of the bill was made by this committee's law revision counsel and a number of amendments pro- posed with respect to changes in terminology and other minor matters. As a result, Subcommittee No. 3 of this committee authorized its chairman, Mr. Willis, to introduce a clean bill (H.R. 18612), which is now favorably reported by the Committee on the Judiciary. STATEMENT BY COMMITTEE The Committee on the Judiciary of the U.S. Senate desires to join in stating its appreciation to Senator Carl Hayden, the chairman of the Joint Committee on Printing, the Public Printer, Mr. James Harrison, and to the assistance given by Mr. John Haley, staff director, and Mr. Louis Anderson, of the staff of the Joint Committee. SUBSTANTIVE CHANGE NOT INTENDED Like other recent codifications undertaken as a part of the program of the Committee on the Judiciary of the House of Representatives to enact into law all 50 titles of the United States Code, there are no substantive changes made by this bill enacting title 44. It is sometimes feared that mere changes in terminology and style will result in changes in substance or impair the precedent value of earlier judicial decisions and other interpretations. This fear might have some weight if this were the usual kind of amendatory legislation where it can be inferred that a change of language is intended to change substance. In a codi- fication statute, however, the courts uphold the contrary presump- tion: the statute is intended to remain substantively unchanged. The following authorities affirm this principle: Stewart v. Kahn (11 Wall. 493, 502 (1871)). Smythe v. Fiske (23 Wall. 374, 382 (1874)). McDonald v. Hovey (110 U.S. 619, 628 (1884)). United States v.
