C. 20503 0~ ar Mrs. Sweeney: This is in response to Mr. Victor Zafra's request for information This Agency provides no special benefits to employees exposed to hostile fire. We conform in general with the salary and benefits paid by other civilian agencies to Federal employees in similar situations. The subject of hostile fire pay is a complex one. The only conclusive finding which emerged from the review of the subject, which we undertook at Mr. Zafra's request, is that we do not perceive a need for general legislation in this area at this time. Mr. Victor Zafra, Legislative Analyst, Office of Management and Budget, called on the status of our supplement to our 29 Septerabvr report on 2. The request for a supplemental report had been made by Zafra on 1 October and is to include the Agency's views on the question of hostile fire pay, the benefits the Agency accords its employees in hazardous situations, and the general principles which the Agency feels should be applicable in those situations. Zafra said Navy i; pushing for the clearance of their report on 3. I told Zafra our likely position would be that while we did not see a present need for general legislation on hostile fire pay, we do not object to theF ut that we would not want to foreclose the possibility of supporting related general legislation in the future if the need arises. 4. Zafra reiterated his statement of 3 October that he wanted our report to include the type of payments made by the Agency to individuals in so-called hostile fire situations, and I told him I believed that as a matter of principle we conform generally with the payment-benefits structure accorded other Federal employees in similar situations. 5. Zafra urged us to get our report in early next week and I told him we would do this. (Confidential - GLC) Called Victor Zafra, MB, to advise him of our response to OMB on and to also let him know that Mr. Maury an .rector had written letters to OMB on our retirement legislation. I discussed with Zafra some of the fringe issues which were involved in He said he had expected us to discuss these areas in our response and formally requested that we provide a followup letter which at least discusses the question of hostile fire pay and other benefits which the Agency accords its employees or feels are applicable in such situations. Zafra mentioned that he has also had to go back to State and AID asking them to expand their responses along similar lines. When I gave Zafra the substance of our letter on the retirement legislation, he brought up the question of a possible increase in Agency and employee contributions in order to maintain our retirement fund. I told Zafra that I was not fully conversant with the fiscal details involved, but asked if this issue had been raised in connection with similar legislation accorded the State Department last year. I also said it had been my under- standing that the funding issue was not a direct result of our substantive provisions and again suggested that OMB clear those provisions and resolve our funding question when that issue was resolved for the other retirement systems. Zafra said the clearance of the Foreign Service provisions had been an error as far as he was concerned and was one in which he was "embarrassed institutionally." He said he would track down our letters and review them. 6.
