5. Received a call from Mr. George Murphy,
on the staff of the Joint Committee on Atomic Energy, concerning the
various reports of a possible Soviet-Chinese clash. He inquired
whether this is an item that is being "floated" by the West or whether
some basis exists for these reports. After checking, I advised that
there has been a steady military buildup, particularly on the Soviet
side of the border, which has been coupled with a continuing propaganda
exchange. These actions have given rise to speculation of the type now
being reported in the press. Mr. Murphy then asked whether the Soviets
had been sounding out their Eastern Europe satellites concerning possible
military action against the Chinese and if so what meaning is attributed
to this action by the Agency. I advised Mr. Murphy that I would relay
the question and be back in touch with him.

1. Mr. Charles Campbell, Legislative
Assistant to Senator Richard B. Russell (D.. Ga.). called and asked if
we would arrange a personnel interview for a
42-year old Rhodes scholar, who has served with the State Department
for 24 years. I told Mr. Campbell that I would check with our people
and be back in touch with him. (See Memo for the Record for details.)
25X1 2. Mr. William Woodruff, Assistant Chief
Clerk, Senate Appropriations Committee, called to say that he had just
returned from leave and would like to see me tomorrow morning. He said
he had briefed Senator Richard Russell (D. , Ga.) on the initial information
25X1 on the which I had provided Woodruff on 12 August, but in view
of recent press stories Woodruff wanted to be sure that this information
was still valid and up-to-date. I told Woodruff of the Director's desire
for a chance to appear before our Subcommittee and clarify our position
25X1 regarding the as soon as possible after Congress returns
from recess. Woodruff reminded me that Senator Russell had expressed
misgivings about future Subcommittee meetings in view of a serious leak
a few months ago and suggested that the Director himself should call
Senator Russell. I told Woodruff we had some significant intelligence
items to report also. Woodruff said that Russell was expected back in
town at the first of the week and he would raise the matter with him, but
still thought a personal call from the Director was very much in order.

3. Mr. Dick Sewell, Administrative
Assistant to Representative Charles E. Bennett (D., Fla.), called in
connection with the suggested reply I delivered on the Green Beret case
and asked if it would be possible to have the identical wording in a letter
from the Agency to the Congressman which in turn could be forwarded to
their constituent. I explained the problems with this approach, which he
agreed existed. Sewell is requesting a letter from Assistant Secretary of
the Army Thaddeus R. Beal on the question of CIA control over the Special
Forces and said they should have referred the matter to Beal in the first
instance.

1. Carl Marcy, Chief of Staff, Senate
Foreign Relations Committee, called in response to my visit to his
office yesterday during his absence. I said I had come by only to
confirm that Senator J. W. Fulbright (D., Ark.) was on safe ground
in replying to an inquiry that certain allegations regarding Agency
dirty work in Brazil were completely without foundation.
Marcy commented on the Pueblo television special last night
and remarked that, like the Green Beret case, it raised certain
questions about effective coordination of intelligence activities which
Fulbright may wish to examine when Congress reconvenes. I told
Marcy that press allegations about the Agency's involvement in the
Green Beret case, and the statements of some of the defense lawyers,
were completely misleading and I would be glad to explain the basic
facts. Marcy said he would be on leave the rest of the week but would
call me after Labor Day.

4. Called Miss Julia Manish, in the
Office of General Counsel, BOB, to determine if the Agency's exemption
under Executive Order 10988 (employee-management cooperation in the
Federal service) was in any way affected by the proposed revisions which
we understand are now being coordinated by BOB. She said the Agency's
exemption had been retained in the initial drafts of the proposed revision,
but deferred to Mr. Roger Jones for a more current reading
OGC, who had prompted this call, was informed of the above and the next
best step seems to be to request the Director of Personnel through his Civil
Service Commission connections to get a reading on the proposed revision
to Executive Order 10988.
5. Frank Tsutras, Administrative
Assistant to Representative James Kee (D., W.Va.), called about the
employment prospects of an upcoming law school graduate who has yet to
satisfy his military obligation. I told him that while we are always pleased
to look at applications on bright prospects it was not our policy to intervene
on draft statuses and that the number of legal-type positions in the Agency
are extremely limited. Mr. Tsutras said he expected as much, but wanted
to check it out with us directly.
6. Mr. Jack Norpel, on the staff of the
Senate Internal Security Subcommittee, called and said the Subcommittee
was considering issuing a subponea on He said they
would appreciate anything that we might be in the position to give them
concerning Williams' arrival and departure dates. I told Norpel I would
talk to our people about this and be back in touch with him if there was
anything that we could pass on to the Subcommittee. Later in the day,
Norpel called and said a decision had been made to suspend any deter-
mination on this issue until the Subcommittee meets after Labor Day
and, therefore, to cancel his request.
7. In response to his inquiry, I advised
Mr. George Murphy, on the staff of the Joint Committee on Atomic Energy,
that his query regarding the classified document alleged to have been
received by a West German publication should be directed to the Army.

1. Dave Barnhill, Senate Constitutional
Amendments Subcommittee of Senate Judiciary staff, substituting for
Larry Conrad who has been handling the Ervin Bill for Senator Bayh
(D., Ind.), called to say that Senator Ervin (D., N. C.) had reviewed
the earlier rough draft of his proposed revisions (which were forwarded
to us on 13 August) and decided to stick with them with only minor changes
but would like to hear our comments as soon as Congress reconvenes on
3 September.
2. Left for Dick Sewell, Administrative
Assistant to Representative Charles Bennett (D., Fla.), a suggested reply.
I asked that Mr. Sewell call me if he had any problem in using this in
responding to a constituent's inquiry concerning Green Beret/CIA involve-
ment.

hold their correspondence on Mrs. Jakobowski, who
is handling this case for the congressman, was away for the week.

6. Hand carried to Mr. Al Tarabochia, on the
staff of the Senate Internal Security Subcommittee, additional texts of
debriefings by the Agency of Mr. Tarabochia
said they were putting some material together on the basis of some
information which we had provided and would probably be in touch with
us sometime next week.
7. Checked with Mrs. Cynthia Swift, on the
staff of Representative James M. Hanley (D., N.Y. ), to determine whether
the Congressman is available either in Washington or his District office.
Mrs. Swift said that Mr. Hanley would not be in touch with either of his
offices until after the recess. We are interested in talking with Repre-
sentative Hanley in connection with his inquiry to the Army about the case
of a former Agency contract employee.
8. Jack Matteson, on the staff of Represen-
tative John Moss' Foreign Operations and Government Information Sub-
committee, called regarding press reports that the Agency had invoked
"executive privilege" in connection with the Green Beret case. He said
that Chairman Moss is extremely sensitive to any abuses of "executive
privilege" by government agencies and will probably inquire about these
allegations. I told Matteson that we had not invoked executive privilege
in the case and did not presently plan to do so. (See Memorandum for
the Record.)

Called Donna Yee, Legislative Clerk,
Senate Post Office and Civil service Committee, to determine the reason
for reporting out two bills (the House-passed Daniel's bill, H.R. 9825,
and Senator McGee's version of that bill, S.7254, with amendments.)
Miss Yee could give me no reason but she believes the Senate will act
only on S.7254, Senator McGee's bill, although she agreed the Senate
could technically consider H.R. 9825 since it is on the calendar.
25X1 2. General Counsel,
NSA, on H.R. 13008 (preparation of a job evaluation and ranking plan by
the Civil Service Commission (CSC) and report of legislative recommenda-
tions to the Congress within two years.) NSA received a request for a
report on the bill from Chairman James Hanley, House Post Office and
Civil Service Subcommittee on Position Classification, and
learned from Subcommittee staff member, Richard A. Barton, that the
legislation was in no way aimed at Agencies such as NSA. Position
classification had been an area of study by the Subcommittee for sometime
now without positive results, and it was thought best to shift the respon-
sibility for completion of the study and legislative recommendations to
25X1 CSC. said he had also talked to CSC on the proposed legislation
and was assured of cooperation.

3. Mr. One Young, Office of Secretary
Defense, Legislative Reference, called to learn the outcome of the Agency's
omnibus legislative proposal to the 89th Congress, which I gave him. His
interest stemmed from proposed draft legislation before him from NSA.

2. Met with Representative Peter Rodino, Jr.,
(D., N.J. ) at his request and briefed him and Gerry Zeitman (staff employee
of Mr. Rodino's Judiciary Subcommittee on State Taxation of Interstate
Commerce) regarding the "Green Beret" case. (See Memo for the Record.)

3. and I lunched with Cy Frieden,
who has recently joined the staff of Senator Thomas Dodd (D., Conn.).
Frieden, an old personal friend from the days when he was a European
correspondent, was interested in the "Green Beret" case on which we
informed him of the essential facts. Frieden cautions that the attorney,
has made a profitable deal with Look Magazine and will
undoubtedly exploit his involvement in the case for all the publicity and
profit he can get. Frieden expects I Ito try to play the case the way
has played the Kennedy assassination, making full use of
references to CIA.
Frieden also thought it likely that Senator Fulbright will interest
himself in the case, and after the current congressional recess may call
the Director for questioning about Agency involvement.

4. Met with Russ Blandford, Chief Counsel,
House Armed Services Committee, and briefed him on indications of an
early ChiCom nuclear test, recent developments re SS-9 deployment, and
Soviet naval vessels in the Mediterranean.
Blandford asked me to give special attention to the case of
who he is strongly recommending for Agency
employment.
Blandford said that he had been getting a lot of questions about
the "Green Beret" case and hopes the facts on which we briefed him last
week stand up under scrutiny. I said that everything we have found out
since confirmed what we have told him.
5. Visited the office of Representative
Richard McCarthy (D., N.Y. ) in response to McCarthy's letter to the
Director regarding unclassified information on Soviet chemical and
biological warfare. No one familiar with the problem was available in
Mr. McCarthy's office, and his secretary suggested that I see the
Congressman personally when he returns to Washington after Labor Day.
6. Checked with Imogene Holmes, secretary
to House Majority Leader Carl Albert, who informed me that Mr. Albert
will not be attending the Nixon/Pak Conference in California on 22 August.

7. Met with Sally Kelley, on the staff of
Senator George Murphy (R., Calif.), and provided her with a copy of
the Agency's brochure and an excerpt from the "U.S. News and World
Report" containing the interview with Admiral Raborn. I suggested that
Miss Kelley use this material in responding to the request of a constituent,
who had requested information on the Agency.
8. Hand carried to Helen Cannen, on the
staff of Senator Alan Cranston (D., Calif. ), a suggested reply for use
in responding to a constituent inquiry from
had expressed concern to Senator Cranston about the "Green Beret" case
and the lack of apparent supervision over the Agency. Miss Cannen said
the suggested reply would serve her purpose nicely. She also showed me
another such inquiry and I helped her in preparing a suggested reply to
that letter.

9. At his request, I met with George Murphy,
on the staff of the Joint Committee on Atomic Energy. Murphy wished
to restate his interest in the NATO security case, Roussilhe. In keeping
with his interest in NATO security cases and the Joint Committee
queries to the Director on these cases in the past, Murphy has asked if
we would keep him informed on this case since he thinks it is highly likely
that atomic energy information is involved despite the fact that Roussilhe
had no formal access to atomal information.
Murphy also expressed interest in the "Green Beret" case. I
told him only that this was an Army case and not one which was run by the
Agency, and that the Agency (contrary to some press allegations) had not
recommended physical termination.
I briefed Murphy on the fact that the Chinese would probably
have another nuclear test probably in September and told him I would keep
him informed of any additional information on this.

10. summer intern in the office
of Senator Robert Dole (R., Kans. ), called for himself to find out the
prospects for summer employment next year. I explained the limitations
of our program and that we would prefer to review applications about six
months prior to graduation. In view of his possible career interest in the
Agency, however, I gave him in the Office of Personnel,
number so that he could have the benefit of a personal meeting as long as
he was in town.

3. Hand carried to Don Diegle, on the
staff of Senator Barry Goldwater (R., Ariz.), the Director's letter to
the Senator responding to his commendation of a congressional intern,
Brian Hessler. At the same time, I covered with Diegle his telephone
inquiry as to whether the Agency had issued a statement on the "Green
Berets" case. I told him we had not made a formal statement and didn't
anticipate that we would since it was somewhat against our policy, in
addition to the fact that this is an Army case and not a CIA case.
Mr. Diegle thanked me and said that Senator Goldwater had expressed
concern thatthe Agency was getting a black eye on this case when it
shouldn't be getting one.
4. Hand carried to Jay Sourwine, on the staff
of the Senate Internal Security Subcommittee, copies of interviews with
covering export of the revolution in Latin
America and Soviet presence in Cuba.

7. With the Director's approval I called
Mr. Gerry Zeitman, of Representative Peter Rodino's (D. , N. J. ) office,
to say I would be glad to meet with Representative Rodino at 11:00 a. m.
on Wednesday, 20 August to discuss the "Green Beret" case. Zeitman
said he would send over a copy of the questions levied on the Secretary
of the Army on which Rodino would appreciate any comments we could
make. Zeitman called particular attention to the question on whether
Special Forces personnel were subject to CIA orders. Zeitman explained
that Rodino doesn't wish to cause us embarrassment or get into sensitive
matters, but does want to assure that his constituent,
gets the full benefit of due process of law.

Goldwater (R. , Ariz. ), called to inquire whether the Agency had issued
any statement concerning the "Green Beret" matter. I informed Mr. Diegle
of our "no comment" policy and said I would check to see if any official

9. Mr. Don DeKieffen, Senate
Republican Policy Committee, called to request information on
Communist China in connection with a paper being prepared by the
Committee staff for distribution to its members. I told him we deal
primarily with classified information and suggested that State Depart-
ment would more likely have the type of information he could use. He
said he had already been in touch with State and would like answers to
several specific questions: (a) why ex-marshal Ho Lung defected to the
USSR; (b) have Chin Chi-Wei and Li Cheng-Fang been purged; (c) the
whereabouts of Chin Keng; (d) was a major military meeting held in
Peking during 3-15 August; (e) what is the nature of the Grand Alliance
Command. After checking with I advised
Mr. DeKieffen that this type of information was available to the research
experts in the Library of Congress and specifically referred him to
Mickey Hagarity and Leo Orleans.

Representative Howard Pollock (R., Alaska), called saying the congress-
man had called from Alaska and was interested in obtaining an Agency
seal for his office. I recalled that two years ago Representative Pollock
expressed a similar interest but that unfortunately we did not have any
available either then or now, but that we would keep his interest in mind
should any be made up for this purpose in the future.
said that some agencies were making plastic copies to cut down the cost
of supplying agency seals to interested members.

1. Jay Sourwine, Senate Internal Security
Subcommittee staff, called to say that Assistant Attorney General Kleindienst
apparently is willing to grant a waiver permitting to visit 25X1A
the U.S. to be available to the Subcommittee. However Kleindienst has
indicated some concern over a point made by Mr. Houston in a conversation
with Kleindienst on 14 August to the effect that the U.K. might not permit
to return there. Sourwine asked whether we thought this point
was a serious one, and whether we would consider extended 25X1A
stay in the U.S. a security threat.
After checking with Mr. Houston I called Sourwine back to point
out reasons for seriously doubting that the U.K. would interpose any
objections to return, and I said that in any event we would not
take any initiative in raising the issue. This seemed to satisfy Sourwine.

Mrs. Joyce Hoare, Personal Secretary
to Representative Peter Rodino, Jr. (D., N.J. ), called this morning to
say that the Congressman would like to have a briefing from the Agency
on the "Green Berets case" sometime in the late morning next Wednesday.
Mrs. Hoare said the Congressman would be leaving town tomorrow and
probably will not be back until Wednesday. I told her I would be back in
touch with her.
Later in the day I tried to reach Mrs. Hoare and was referred
to Mr. Gerry Zeitman. I told Mr. Zeitman that if it was satisfactory I
would call him on Monday on this. He said this was perfectly all right as
long as their request was "in the works." Mr. Zeitman apparently is on
the staff of Mr. Rodino's Judiciary Subcommittee on State Taxation of
Interstate Commerce but he said he was working with the Congressman
on this case.

6. Talked with Paul Hayes, in Senator
Lee Metcalf's (D., Mont. ) office, about the Senator's letter asking if
we could authenticate the alleged Communist Rules for Revolution. (Senator
Metcalf made a statement on the floor of the Senate yesterday on this. )
provided Hayes with a blind memorandum on the subject which had been
prepared on material provided by the CI Staff. This memorandum did
not disagree with Metcalf's conclusion -- based on responses from the
Library of Congress, FBI, and the Senate Internal Security Subcommittee --
that the document could not be authenticated. Hayes appreciated our seeing
him on this. Hayes, who is on a Congressional Fellowship which terminates
today, works for a Milwaukee newspaper and had handled this project for the
Senator.

Relations Committee a letter from Carl Marcy to Mr. Maury on an inquiry

the Senator said he would not expect the defense appropriations bill
to be cleared before November or December. He is expecting strong
oppostion by a number of the Senators on each item in the defense bill.

since this would facilitate the work on the study and might result in an
advanced publication date.

Atomic Energy staff, called regarding the case of a French national
involved in espionage in NATO which we had discussed earlier. Murphy
said he was not entirely satisfied with my original statement that we had
no reason to believe any U.S. atomal information had been compromised
recalling that this had been our initial comment in connection with both
25X1 the but later investigation proved the contrary.

I told Murphy my statement was based on our only information to date.
He said he was in a continuing battle with the State Department to limit
the distribution of sensitive atomal information within the NATO community
and cases of this kind would be very helpful in supporting his position if
we could show that atomal information had been compromised. I said if we
got any such information he would be advis.ed but we were not primarily
responsible for the investigation and he should refer his questions to the
Pentagon who I assumed was in the best position to reply. I reminded him
that normally such investigations in the field would be conducted by Colonel
Ives, of the NATO Security Staff. Murphy said he knew all this but still
wanted to be certain the Agency was following the case closely and would
inform him of anything of concern to the Joint Committee.

NATO security case and advised that the individual involved did not have

Captain Budget Williams, one of the Special Forces officers involved, was
from Athens, Georgia, Senator Russell may want to "talk to someone" more
about the details if Williams' family appealed to him for assistance. See

which is Mr. MacGregor's office. A current situation briefing of Poland

advised that the Agency does not publish a compendium of the oil companies
of the world. It was suggested that, although we were not familar with such
a publication, he might want to check with the Department of Interior.

6. In the absence of Mr. Arthur Kuhl, Chief Clerk,
Senate Foreign Relations Committee, I met with Mrs. Mary McLaughlin,
Assistant to Mr. Carl Marcy, Staff Director, and reviewed with her the
handling of the transcript of the Director's briefing of 23 April and 23 June
during their study of this ABM testimony over the past few weeks by the
Committee members. I also received back from Mrs. McLaughlin copies
2,4, and 5 of the Director's testimony of 23 June which was "inadvertently"
retained by the Committee. Future calls for the transcripts may be anticipated
from time to time. They may involve one or more transcripts which will be
returned to the Agency each day. Mrs. McLaughlin was once again highly
complimentary of the services provided by the Agency couriers. Mrs.
McLaughlin noted that they had been most helpful and courteous.
7. Attempted to see Larry Conrad and Marcia
MacNaughton concerning developments in the Ervin Subcommittee but both
individuals were away from their respective offices for the day.
8. Received from Mary Miller, on the
staff of the Senate Preparedness Investigating Subcommittee, a classified
document that had been provided for Subcommittee use. A receipt was given
for the return of the document.
9. Talked briefly with Mr. Robert Michaels,
on the staff of the House Appropriations Committee, and brought him up-to-
date on the Soviet space activities discussed with him yesterday. Mr. Michaels
was most appreciative but noted in passing that, although he is spending quite
a bit of time with the Chairman, they are so pressed with Committee work
he is not certain when the Chairman will have time to be briefed on such matters.
10. Delivered to the office of Representative
Joel T. Broyhill (R., Va.) correspondence from the Director of Strategic
Services Unit enclosing citations -- the Medal of Freedom and the Medal of

the House Armed Services Committee, and brought him up-to-date on
Soviet space activities discussed with him yesterday.

Also reviewed with him a blind memorandum of 7 August prepared
by the office of the DDI on "Russian-trained warlord" in Sinkiang. This
paper was written in response to a query by Representative John E. Hunt
(R., N.J. ) during the Director's briefing of the House Armed Services
Committee on 29 July. Mr. Slatinshek advised that Representative Hunt
is away from the city on a trip and requested that our office provide the
response directly to him and then include it in the transcript of the hearing
after Representative Hunt's review.
12. Met with Mr. Walter Mote, Admin-
istrative Assistant to Vice President Agnew, and provided a copy of a
letter from Mahlon. R. Blanchard about whom the Vice President's office
had inquired earlier. Mr. Mote thanked me very much and advised that
this matter can now be held in abeyance. If any further action is desired,
he will advise.

Senate Aeronautics and Space Sciences Committee, and brought him up-
to-date on Soviet space activities which we had discussed yesterday.

14. Received a call from Mrs. Glee Gomien,
Assistant to Senator Everett Dirksen (R., Ill.), who thanked me for the
assistance provided earlier and advised that the Chicago corporation
which had difficulty in getting a visitor's visa to Czechoslovakia for one
of their people is now sending a senior official to Germany to look into
the matter. This call from Mrs. Gomien was merely to tidy up and to
be sure that she had not left the impression that any further assistance
in this matter was needed at this time.

Senate Subcommittee on Constitutional Amendments, who advised that he
checked with Miss MacNaughton, Subcommittee on Constitutional Rights staff,
this morning, but no Subcommittee material is available for review by the
members. It was his impression that Senator Ervin himself is working on
the rewording of amendments to S. 782. Mr. Conrad will call and provide us
with a copy of the Subcommittee draft when it becomes available.
Mr. Conrad noted in passing that it appeared to him to be the sense of
the Subcommittee meeting yesterday that the Agency and its representatives
are in quite good favor with the Subcommittee, but that NSA does not enjoy
the same consideration. He passed this on for what it was worth.

6. Met with Mr. Robert Michaels, House Appropriations
Committee staff, who advised that Chairman Mahon's schedule had not allowed
discussion of the Agency's letter concerning withdrawal of $2. 5 million
from Reserves. He suggested that for future months it might be well for the
record if a very brief letter, referring to the original and stating the amount
of withdrawal, be forwarded to the Chairman.
I briefed Mr. Michaels on the following items:

9. Met with Representative Olin E.
Teague (D , Texas) in response to his question earlier in the week concerning
ransoming of American prisoners in Vietnam. I advised that the United States
Government has tried every possible way of opening the prisoner release
question and at every possible level. A special interagency committee of
State and Defense Department representatives, formerly called the Warneke
Committee, has headed up this effort. Mr. Teague appreciated the advice
and noted that this subject is one he intends to take up with President Nixon
because there must be some channel or avenue that can still be tried to recover
American prisoners held by North Vietnam. No further action by the Agency
is requested.
10. Met with Mrs. Mary McLaughlin, Senate
Foreign Relations Committee staff, who apologized for the inconvenience
caused the Agency couriers last evening and expressed Mr. Marcy's
apologies as well. The Committee is in the process of drawing up a new list
of staff personnel and phone numbers, a copy of which will be provided as
soon as it is ready. Mrs. McLaughlin also advised that we can discontinue
daily delivery and pickup of the transcript of 23 June after today. She was
most complimentary on behalf of the Staff Director for the manner in which
the delivery and pickup of the transcript has been handled by the Agency couriers.
11. Received a call from Mrs. Caroline
Bogan, assistant to Representative Bill Scott (R., Va. ), who advised that the
United Virginia Bank of Fairfax is interested in putting a branch in the Central
Intelligence Agency building and desired the name of an Agency official they
could talk to. After checking with DDS, I again advised
that the Agency Headquarters Building is a secure area and that we do not
have business facilities located in the building. name
was given to Miss Bogan in the event the bank desires to make further inquiry.

Senator Birch Bayh (D., Id.) and Mr. Larry Conrad, Chief Counsel of his

25X1 3. Briefed Senator Birch Bayh in preparation
for his upcoming travel to the Soviet Union covering security matters, travel
suggestions, and possibility of his getting to see interesting Soviet officials
and subjects which might be discussed with them. I recommended that on
the latter points he be guided mainly on the advice of the Embassy.
25X1 4. Received a call from Mrs. Glee Gomien,
assistant to Senator Everett Dirksen R., Ill.), concerning the case of an
official of the Barber-Colman Company, Rockford, Illinois, who has apparently
been having difficulty in obtaining a visa to visit Czechoslovakia on business.
The company has been advised that a visa could be obtained by having their
official travel with two members of HOr and Company of Vienna, Austria.
Only the family names of the two individuals of H6r and Company are available.
After checking with Mr. Halpern I advised Mrs. Gomien that she should check
with the Department of State on this matter, that travel into Czechoslovakia by
any form of trick would appear to be risky in view of the apparent refusal of
the Czechoslovakian government to issue a visa in a normal fashion. Mrs.
Gomien later called and advised that the official of the Illinois firm turns out
to be a West German national and that she is forwarding the matter to the
Department of State.

S. In response to his earlier call, I
advised Mr. Gilbert LeKander, Administrative Assistant to Representative
Frank T. Bow (R. , Ohio), that a father's mental illness would not automatically
disqualify an applicant for employment with the Agency. It would, however,
bring special attention in review of the individual's own medical qualifications.
Mr. LeKander was most appreciative and advised he would relay the information
to Mr. Bow. See Journal of 4 August 1969.

personal secretary to J. R. Blandford, House Armed Services Committee,
who requested for Chairman Rivers a fact sheet on the news reports concerning

8. In followup of my meeting last evening
with Miss Marcia MacNaughton, Professional Staff Member, Senate Sub-
committee on Constitutional Rights, told her the personality testing has
not changed since 1966. We did not discuss the effect of the proposed
legislation on Agency use of personality tests which was also covered in the
Chairman's letter of 1 August. Miss MacNaughton called me later in the day
after the Subcommittee's meeting and advised that several considerations on
possible amendments were discussed but no vote was taken by the Subcommittee.
In all probability she feels the Agency's desires will be met in the amendments
with the exception of the inclusion of the requested reference of section 102(c)
of the National Security Act. Tee Memo's for Record for-details.

9. Talked to NSA,
at various times during the day bringing him up-to-date on events in the
Senate Subcommittee on Constitutional Rights and reached agreement with
him that the Agency and NSA would respond individually to the 1 August 1969
letter from Senator Ervin concerning the Agency's and NSA's policies and
procedures relating to personality testing. Advised that the 25X1A
pressure for response is off since the Subcommittee has met, but that
Miss MacNaughton advised the Chairman still desires a written response

1. With the Director's concurrence, I called
Mr. Doug Baldwin, in the office of Representative John Wold, to say that
the Agency was no longer responsible for the pacification program in Vietnam
and to suggest that Mr. Wold and his colleagues, Representatives Dennis
and Landgrebe, would get a more useful and broader presentation of this
and other Vietnam matters from the Defense Department.
2. Called Senator Birch Bayh in response to his
earlier attempt to reach Mr. Carl Duckett. Senator Bayh said he wished
to get details on the accuracy of the SS-9--that he understood Secretary Laird
was being quoted in the Safeguard debate as saying the SS-9 now has a CEP
of one-quarter mile, but Bayh questions this and would like verification. I
said I would come by his office and discuss this matter personally.
After checking the latest "Memo to Holders" on the subject, I called
on Senator Bayh to say that the community is in agreement that at present
the SS-9 CEP is probably not less than .5 miles or more than .75; that in
order to bring it down to .25 miles a new guidance system would be necessary,
but we have no evidence that such a system is under development and do not
believe such a system could become operational before 1972.
3. Showed Senator Birch Bayh a draft letter
to Senator Sam J. Ervin explaining our reasons for opposing publication of
the Director's testimony regarding S. 782 before the Constitutional Rights
Subcommittee. Senator Bayh 'said he thought the draft was satisfactory.
Discussed with Senator Bayh and Larry Conrad, Chief Counsel of
Bayh's Subcommittee on Constitutional Amendments, our draft "fall-back"
amendment providing for the intelligence community limited exemptions from
S. 782. Bayh indicated that at tomorrow's meeting of the Subcommittee on
Constitutional Rights he would raise the poss ibility of a full exemption for the
Agency but if, as expected, this was unacceptable, he would propose our
suggested fall-back position.

(Ervin bill). Pohlenz said Senator Hruska had been quite impressed with
the Agency presentation on 22 July and was anxious to be helpful. I explained
to Pohlenz the draft amendment for limited exemption for the intelligence
community and Pohlenz commented that he thought we had gone as far as
possible in meeting Senator Ervin's objections to a complete exemption and
was reasonably certain that Senator Hruska would actively support our "fall-
back" version.
7. In the absence of Senator Stio m Thurmond,
met with his Legislative Assistant, Glen Smith, and explained to him our
proposal for a limited exemption from S. 782 (Ervin bill). Smith said he was
sure Senator Thurmond agreed with our position in principle, but would be
reluctant to directly oppose Senator Ervin. However, Smith was sure that
Thurmond would privately try to prevail upon Ervin to accept our compromise
amendment.
8. Left with Winston Bryant, Legislative
Assistant to Senator John L. McClellan, a copy of our proposed compromise
amendment for limited exemption from S.782. After studying this, Bryant
called me to say he would carefully explain it to the Senator and was sure
Senator McClellan would support it.

9. Larry Conrad, Chief Counsel, Subcommittee
on Constitutional Amendments, called to say he had been in further negotiation
with Marcia MacNaughton, staff of the Constitutional Rights Subcommittee,
an felt progress was being made regarding our proposed amendment for
limited exemption but he wished to be reassured that we considered the
Agency bound un.der this amendment by all of the provisions of S.782 except
Section 1(k), Section 4 and Section 5. After consulting with Mr. Houston
and Mr. Warner, OGC, we called Conrad back to say that this was true
but pointed out that our proposed amendment specifically provided that
nothing in the Act should affect the Director's authority as set forth in
Section 102(c) of the National Security Act of 1947. We explained our view
that this Act did not seem directly related to S. 782--that Section 102(c)
was intended, and interpreted, to take care of special cases affecting the
national security, etc. , but apparently would have no bearing on cases arising
from a violation of the provisions of S.782. Conrad said this was his impression
but he appreciated our comments.
Conrad said that Miss MacNaughton had expressed some optimism
that our compromise proposal might be acceptable.
10. Talked to Mr. Pat Holt, Senate Foreign
Relations Committee staff, and advised in response to his question to
Mr. Houston yesterday that the Agency has not subsidized the Hawthorne
Press and Pergammon Press. Mr. Holt indicated he was sure this would
be the case.
Mr. Holt advised he will be traveling next week to Lima, Peru, and
would like to meet' [there. The exact date of departure or time
in Peru is not yet certain. I indicated I would relay his request and be back
in touch with him.
11. Received a call from Mr. James Cline,
Counsel, House Immigration and Nationality Subcommittee, who advised he
will be traveling with Representatives Byron G. Rogers (D., Colo.) and
Clark MacGregor (R., Minn.) to Warsaw and Prague probably departing
sometime next week. It would be appreciated if a country briefing could
be provided some time on Friday.

Talked to Mr. Robert Hull, Department
of State, concerning the status of the Daniels/McGee legislation and advised
that no final Agency decision has been made as to the substantive provisions
to be included in updating the Agency's retirement program pending passage
of this legislation. Mr. Hull indicated that the Department of State has had
no further conversations with the House Foreign Affairs Committee which is
fairly well geared to introduction of amendments to the Foreign Service Act
along the lines of the McGee/Daniels legislation.

1. Received a call from Mr. Gilbert
LeKander, Administrative Assistant to Representative Frank T. Bow
(R., Ohio), who related that a young man from their district has applied
for employment with the Agency and is concerned whether his father's
illness might count against him in consideration for employment. The
father was retired from the Navy for mental illness some ten years ago.
The son has just completed three years of "good duty" with the Navy.
Mr. LeKander asked if we would advise what the Agency's medical policy
might be in such a case.
Z. Received a call from Mr. J. Sourwine, Chief
Counsel, Senate Internal Security Subcommittee, who noted that he was
surprised that the debriefing material furnished Mr. Tarabochia, of the
Subcommittee staff, is all that is available. He noted that if it were a
question of selection of material for release at this time his staff would
be able to work with whatever summaries or other outline could be provided.
If not, he would appreciate the scheduling of a possible two days of meeting
with Orlando Castro Hidalgo. Advised Mr. Sourwine I would relay his
request and be back in touch with him.
3. Received from Austin Smith, House
Appropriations Committee staff, a copy for John S. Warner of a 30 June
1969 letter to Secretary of the Army Resor from Chairman Mahon.
4. I In response to a call, met with Mr. George
Murphy, eputy Director, Joint Committee on Atomic Energy, and received
from him a chronology on the decisions leading to the building of the hydrogen
bomb for our review for security and sensitivity prior to publication by the
Committee. Mr. Murphy advised that AEC and DOD have reviewed the
document. No suspense date for completion of the security review has been
established by the Committee.

5. Delivered to Mr. William Woodruff, Counsel,
Senate Appropriations Committee, a letter to Chairman Russell concerning
withdrawal of $2.5 million from the Reserve. After reviewing the letter
Mr. Woodruff advised that he hopes to take the matter up with Senator Russell
this evening.
6. Delivered to Mr. Robert Michaels, House
Appropriations Committee staff, a letter to Chairman Mahon concerning
withdrawal of $2.5 million from the Reserve.
7. Mr. Ernest L. Kerley of the Legal Adviser's
office, Department of State, and I met with Mr. Pat M. Holt, Senate Foreign
Relations Committee staff, at the latter's request to discuss an inquiry
received by the Committee about United States liability for the sinking of
the Springfjord in 1954 at the time of the Guatemalan rebellion. We gave
the details of the episode, and Mr. Holt accepted the Department of State's
position that the U.S. Government was not liable. He said this would take
some care in answering, as the inquiry was from a U.S. lawyer who knew
Senator Fulbright, but he would discuss the case with the Senator and try to
answer along the lines that the Committee had investigated and was satisfied
that the U.S. Government was not liable in this incident.
At this same meeting with Mr. Holt he asked me if this Agency were
subsidizing two publishing outfits, Hawthorne Press and Pergammon Press.
I said the names were not familiar to me and gave them later to
who will investigate and report back to Mr. Holt.
8. Received a call from Mr. Coal, in the
office of Senator Norris Cotton (R. , N.H. ), who requested an employment

9. Accompanied the Director who called on
Chairman James 0. Eastland, Senate Judiciary Committee, regarding
S. 782 (Ervin bill). The Director explained our problems with Senator
Ervin's request that the transcript of our hearing before the Subcommittee
on Constitutional Rights be sanitized for publication, and our desire to
obtain exemption from certain provisions of the bill. Senator Eastland
agreed that the transcript should not be published, and said he understood
our problems with certain provisions of the bill. He said he was at a
loss to explain Senator Ervin's attitutde in the matter. Senator Eastland
suggested that we might contact Senators McClellan, Bayh, Hruska, Thurmond,
Dirksen and Russell.
After our meeting with Senator Eastland, the Director instructed that
1 draft a letter explaining to Senator Ervin our reasons for finding it impossible
to agree to publication of any version of the transcript and check this draft
with Senator Bayh.
10. Larry Conrad, Chief Counsel, Senate
Subcommittee on Constitutional Amendments of the Judiciary Committee,
(Senator Bayh is Chairman) called to say that he was working in Senator
Bayh's behalf in connection with our problems on the Ervin bill. He
explained that he had just talked with Marcia MacNaughton, of Senator
Ervin's Subcommittee on Constitutional Rights, who had commented that
the Ervin Subcommittee was meeting on Wednesday, 6 August, and wanted
to report the bill out as soon as possible. She asked Conrad to try to work
out a "limited exemption" for the Agency and NSA for consideaation at the
6 August meeting.
Conrad expressed considerable concern over the fact that copies of
the transcript of our 22 July hearing, although classified "confidential",
were being freely disseminated among the Subcommittee members and
staff officers with no security controls whatsoever.
25X1 11. Called Chairman David Henderson, House
Subcommittee on Manpower and Civil Service of Post Office and Civil Service
Committee, and explained to him our problems with the Ervin bill and the
terms we had in mind for a suggested limited exemption as requested by
Larry Conrad (see above). Henderson said he thought we would have trouble
with an exemption from a provision for the right of counsel for aggrieved
employees, since Ervin was under heavy pressure from employee organizations
in this connection. Henderson fully agreed we should strive for an exemption
from the provisions giving aggrieved employees immediate access to Federal
courts. He fully endorsed our suggestion that aggrieved employees should
have access to the Employees' Review Board only after exhausting administra-

Senator Ervin requesting clarification of the extent to which Agency and
NSA personality tests for applicants or employees would be affected by
certain limitations contained in S. 782. DDS is drafting a response and
coordinating it with NSA.
25X1 13. Received a call from Doug Baldwin,
in the office of Representative John Wold (R. , Wyo. ), who said that
Representatives Wold, David Dennis (R., Id.) and Earl Landgrebe (R. ,Ind.)
are planning a trip to Vietnam for the period 13 August to 3 September and
would like an Agency briefing on the .pacification program and the Vietnam
situation. I said I would call him back and let him know whether something
could be "Sf ranged.

1. Accompanied by Steve Lukasik, Deputy Director,
ARPA, I met with Mr. Carl Marcy, Senate Foreign Relations Committee
staff, regarding Senator Fulbright's letter of 17 July to Secretary Laird
concerning a sensitive installation (I had previously, at
Senator Fulbright's request, generally explained the nature of this facility
to Marcy, see Journal of 29 July 1969.) Mr. Lukasik gave Marcy an advance
copy of the letter Secretary Laird is sending Senator Fulbriplit c-ontaining the
overt version of the installation, coupled with the official
agreement. Marcy said these documents would serve as a satisfactory
basis for answering any questions on the matter, and he would guard the
sensitive aspects.

2. Attempted to see Senator John Stennis to
discuss with him our problems with Senator Ervin regarding the publication
of a sanitized version of the transcript of the Director's testimony before
Senator Ervin's Subcommittee on Constitutional Rights regarding S. 782.
Senator Stennis said he was completely preoccupied with some urgent matters
and unless our problem was urgent, he would like me to take it up with
Mr. Braswell, Chief of Staff, Senate Armed Services Committee.
I talked with Mr. Braswell explaining to him our reasons for opposing
publication. He said he was sure Senator Stennis would agree with our position
but doubted Stennis would intervene directly with Senator Ervin. He said he
would take the matter up with Stennis at the first opportunity, probably late
this evening when he expected to see him for a few minutes, but could only
advise us to stand firm in opposing publication of any version of the
briefing.

3. Met with Bill Woodruff, Senate Appropriations
Committee staff, and explained the above problem with Senator Ervin.
Woodruff thought it unlikely that Senator Eastland would give us a hearing
before the full Judiciary Committee and suggested we try to persuade
Senators Eastland and McClellan and any other sympathetic members of the
Committee to press for an exemption before reporting out the bill.
Woodruff seemed concerned about the Safeguard matter which he
predicted might turn on a single vote.
Woodruff also expressed grave concern over SALT talks with the
Soviets, remarking that in his view any agreement excluding on-sight
inspection would be "disastrous." However, he said the Fulbright crowd
is riding high" and anything can happen.
I briefed Woodruff on the Sino-Soviet and Middle East situations.
Woodruff said Senator Russell has been in "fine shape" this week,
and Woodruff himself has largely recovered from his recent ulcer attack
and is now working full time.
4. Met with Mr. J. R. Sewell, Administrative
Assistant to Representative Charles Bennett (D., Fla.), and advised that
Agency representatives have met with a constituent
recommended to the Agency by Representative Bennett. Advised Mr. Sewell
that the Agency will in all probability maintain infrequent contact with
