Executive Assistant to Senator Edward J. Gurney (R., Fla. ),
about the letter the Senator received from a constituent, Mr. William

inquiry to the State Department on this was referred to us by State. I
told Mr. Bastien that the Agency did not comment on matters of this
sort but that I had talked to Mr. Jack Norpel, of the Senate Internal
Security Subcommittee staff, who would be happy to provide him with
the names of some recent publications on Philby that might be of interest
to Mr. Bastien thought this would be very helpful and would
be, responsive to communication.
2. (Unclassified - JMM) During a conversation with Representative
John Moss, Chairman of the Forgign Operations an Govern} nt, Information
Subcommittee of House Government O eration I recalled the
Navy about the over-classification of an item which turned out to be of Agency
origin. I told Mr. Moss that this was a rather common problem, but arose
from the fact that even though the item was from a Soviet publication,
Voyennaya Mysl' (Military Thought), it was not widely distributed and since
our only access to such material was through a unique and sensitive source
we often had to restrict knowledge of our possession of it. I said I was aware
of Moss' concern about over-classification within the Government, and when-
ever he had any problems with the Agency in this regard I hoped he would call
on me. (I have known Mr. Moss socially for some years but have had no
recent official contact with him.) Mr. Moss said he understood the problem
and would indeed take advantage of my offer if the occasion arose.

MEMORANDUM FOR THE RECORD
SUBJECT: Meeting with Jack Matteson re Agency's Authority
for Refusal to Provide Witnesses & Information
in Prosecution of Green Berets
1. Jack Matteson, Professional Staff Member, House Foreign
Operations and Government Information Subcommittee, called and advised
he had just received a personal note from Chairman Moss asking him to
check the authority for the Agency's refusal to provide witnesses and infor-
mation in the prosecution of a "criminal trial" involving the Green Berets.
Representative Moss' appetite was apparently whetted by an item in this
morning's New York Times that indicated in effect that the citation of legal
authority for this action "was not readily available. " I thanked Jack for the
call and told him I would try to be back in touch this afternoon, but if not,
then first thing tomorrow.

3. Mr. Matteson found the reference to the uniform military code a
difficult authority to digest. In his attempt to reflect Representative Moss'
views, Jack did not feel that the Manual for Courts Martial should have
application to actions by the Director of Central Intelligence. It was neces-
sary, therefore, to review with him the normal processes involved in
requesting witnesses or information for use in a trial under the Manual for
Courts Martial and, as in this case, the attendant determination by the head of
an agency to authorize agency personnel, etc. , to be used or not in accordance
with the "rules" spelled out in the manual.

4. Although Mr. Matteson was not fully convinced himself and
was quite hesitant about the reception that will be given this information
by Chairman Moss, he agreed that he would check with Colonel Chilcoat
before proceeding further with a formal request to the Director for cita-
tion of the authorities relied upon by him in the publicized determination
concerning the availability of Agency witnesses and information in the
prosecution of the Green Berets. He will call if he encounters difficulties
with Army JAG. It was also agreed that I would go by during the morning
to meet with him.

staff of the Senate Internal Security Subcommittee, additional texts of
debriefings by the Agency of Mr. Tarabochia
said they were putting some material together on the basis of some
information which we had provided and would probably be in touch with
us sometime next week.
7. I Checked with Mrs. Cynthia Swift, on the
staff of Representative James M. Hanley (D., N. Y. ), to determine whether
the Congressman is available either in Washington or his District office.
Mrs. Swift said that Mr. Hanley would not be in touch with either of his
offices until after the recess. We are interested in talking with Repre-
sentative Hanley in connection with his inquiry to the Army about the case
of a former Agency contract employee.
8. Jack Matteson, on the staff of Re re?sen-
_tative John Moss' Foreign Operations _and Government Information Sub-
jommitt`, called regarding press reports that the Agency had invoked
"executive privilege" in connection with the Green Beret case. He said
that Chairman Moss is extremely sensitive to any abuses of "executive
privilege" by government agencies and will probably inquire about these
allegations. I told Matteson that we had not invoked executive privilege
in the case and did not presently plan to do so. (See Memorandum for
the Record.)

SUBJECT: Conversation with Mr. Jack Matteson, Foreign
Operations and Government Information Subcommittee,
Re Green Beret Case
1. This afternoon I called Mr. Jack Matteson, on the staff
of Representative John Moss' (D. , Calif.) Foreign Operations and
Government Information Subcommittee, in response to Matteson's
earlier call to regarding the Green Beret case. Matteson
was interested in press reports that the Agency had claimed executive
privilege in connection with the military investigation in Saigon, and
remarked that this was something that would be of major concern to
Representative Moss (now in Sacramento). Having earlier checked
with Mr. Houston, I told Matteson that in the present hearings under
"Article 32" the witnesses are under no compulsion to answer any
particular question, and the matter of executive privilege was irrele-
vant. I pointed out that the Military Court Martial Manual authorizes
heads of agencies to invoke executive privilege where they consider it
necessary, but I explained that the Agency had not invoked executive
privilege in the present hearings and was fully cooperating with the
military authorities in the investigation. I added that at the present
time we had no intention of invoking executive privilege.

Senate Republican Policy Committee, concerning back copies of the FBIS
Daily Report for March, April and May. After checking with FBIS advised
Mr. DeKieffen that copies are not retained for more than a month. He

he could obtain them from one of his members who does maintain a file of
FBIS reports.

1. Talked with Bill Woodruff, on the staff of
the Senate Appropriations Committee, and advised him that the special
clearances for Guy McConnell have been approved. I also urged Woodruff
to get together with Bob Michaels, on the staff of the House Appropriations
Committee, at his earliest opportunity to discuss the procedure to be
followed concerning the funding of the Radios.
2. Called Winston Bryant, on the staff of
Senator John McClellan (D., Ark. , to advise him of Senator Ervin's
decision to allow the Agency to appear before the Constitutional Rights
Subcommittee in executive session on S. 782. I told Bryant the appearance
has been scheduled for the 22nd of July at 10:30 a. m. and expressed our
sincere hope that Senator McClellan would attend.
3. Advised Oneta Stockstill, on the staff
of the House Armed Services Committee, that the week of 28 July appeared
to be the best time for the Director to brief the full House Armed Services
Committee. Mrs. Stockstill said she will pass this on and be back in touch
with us with a suggested date.
4. Senator Joseph Tydings' (D. , Md.) office
called and suggested that I see the Senator at 2:00 p.m. on Thursday, 17 July.
This has to do with our interest in approaching the Senator regarding an
Agency employee with whom he has been in contact.
5. Mr. Houston advised that OGC had been
in touch with the Library of Congress on the inquiry which originated with
Representative Dante B. Fascell's (D. , Fla.) Subcommittee on Legal and
_'Monetaw_Affairs- of the House Operations Committee. OGC has taken care
of this item and there is no further need for contact with the Congressman.

11. In the absence of Representative Dante B. Fascell
(D. , Fla. ), I talked with Mr. Michael Finley, of his staff, regarding the letter
from the Library of Congress for information concerning Agency investigative
personnel. I explained to Finley that our General Counsel's office was advising
the Library of Congress that we would not be responding to their request which
was being made as a result of a requirement on Cyan res_sman,_, ascell's Subs
committee on Legal and Monetary Affairs of the House Operations Committee.
I asked Finley, however, to assure Mr. Fascell that we would be glad to discuss
this matter with him personally if he desired anything from the Agency. I also
asked for an opportunity to speak with Mr. Fascell about this at his earliest
convenience. I left with Mr. Finley a copy of the Library of Congress letter to us.
12. Met with William Woodruff, on the staff of the Senate
Appropriations Committee, and briefed him on the latest information on Soviet
ICBMs as well as the latest developments in the Sino-Soviet situation, scheduled
visit of Soviet warships to Cuba, and the intensive air action in the Middle East.
I also talked with Woodruff regarding our conversations with Robert
Michaels, of the House Appropriations Committee staff, on?RFE and RDC. (See
Memorandum for the Record for details. )
13. Met with Robert Michaels, on the staff of the House
Appropriations Committee, and advised him of my conversation with Bill Woodruff
on the subject of the Radios and RDC. Michaels agreed it would be desirable for
him to get together with Woodruff on this. I indicated that we would be perfectly
happy to get together with them jointly or separately whichever they wished.
14. Picked up from the Subcommittee on National
Security and International Operations, an advance copy of the speech which
Senator Henry Jackson (D. , Wash.) will be giving on the floor today; and which

that is a longtime friend of Representative Brown which was
the reason for Brown's approach to the Agency through Representative
Glenard Lipscomb (R., Calif.) in the first instance.
12.~ Met with Mr. Jack Matteson, Hous
Government O erations Committee Subcommittee on Foreign O e rations
and Government InformationJstaff, as a followup to an earlier meeting
concerning Chairman Moss' interest in classification of certain translations
of Soviet documents. Mr. ' Matteson advised that Chairman Moss' schedule
is such at this time that he felt it best not to pursue the question of a possible
meeting with Mr. Maury to detail the particular case at hand since the matter
had been resolved in our previous meeting (see Journal item of 2 June.) It
would be best to let this matter lie and to save any future clarification of
Agency classification procedures for another time.
13. Met with Mr. Robert Michaels, House
Appropriations Committee staff, who advised that the Government Accounting 25X1
Office had provided for Committee staff on a number of GAO
research contracts.
Mr. Michaels would appreciate advice whether
the Agency is in any way involved in these contacts and what the relationship
might be with the Agency. In passing Mr. Michaels noted that the Navy pro-
vided a showing of the Soviet film, "True Sons of the People, " in the speaker's
dining room a week or so ago. Several members of the .Appropriations Com-
mittee were in attendance.

Mr. Maury, assured Mr. Gerald Schatz, Subcommittee on Conservation and,
Natural Reso,r.c_Qs staff, that all Federal installations controlled by the Agency
would be reported to the Subcommittee in connection with its air pollution
survey. Schatz agreed that if GSA separately reports on property carried in
the Agency's name on the Annual Real Property Inventory, such as the Head-
quarters building, a duplicate report would not be required from the Agency.
I assured him we would advise the Subcommittee if this transpires.
12. (Internal Use Only - LLM) Called Jerry Sohns, BOB, concerning
proposed legislation being processed through BOB for clearance to provide
for exclusive remedy under the Tort Claims Act in the case of malpractice
suits against physicians. Mr. Sohns will send us a standard request for
views. OGC, alerted us to Agency interest and the proposed
legislation.

1. This is an interim reply to a congressional committee request to
Mr. Helms concerning air pollution. I believe the interim reply should be
signed by you rather than by the DD/S. I also believe the letter prepared
for DD/S signature raises unnecessary questions as to whether we intend
to fully comply with the committee's requirements. I have changed the letter
to eliminate this possible problem and to conform (hopefully) to your style.
2. Our final report will be in full compliance with the committee's
request, which is for information. on information carried in the "Annual
Real Property Survey." You will note that three Agency occupied installations
in the metropolitan D. C. area will
not be included in our final report because they are carried on GSA's Annual
Real Property Inventory and not CIA's. Thus, if the committee does not
request a pollution abatement report from GSA (which they haven't up to now),
the committee will not receive information on these three installations.

The Clean Air Act as revised by the Air Quality Act
of 1967 (sec. 111, Public Law 90-148; 81 Stat. 485, 499)
and Executive Order 11282 of May 26, 1966, require Federal
agencies to demonstrate leadership in the national struggle
against air pollution by controlling and reducing atmospheric
emissions from their installations.
Because there has been relatively little progress in
this program since 1966 this Subcommittee is undertaking a
survey of air pollution abatement at Federal installations.
We will appreciate your furnishing us the information re-
quested on the enclosed tables, in triplicate, not later
than August 1, 1969.
These tables request data on:
l.Status of, and plans for, control of atmospheric
emissions, as of April 1, 1969, at your agency's
installations within the six Air Quality Control
Regions established prior to that date; and
2. The nature and extent of fuel shifts planned
by your agency's installations throughout the
United States for purposes of air pollution
abatement.
Enclosed with the questionnaire tables is a statement
of instructions. Any questions regarding the survey may be

Survey of Air Pollution Abatement by Federal Installations, 1969
Instructions
This survey is to reflect conditions as of April 1, 1969, except
where otherwise indicated. The enclosed tables are to be completed and
returned in triplicate to the House Conservation and Natural Resources
Subcommittee on or before August 1, 1969. If additional pages are needed,
please use paper of same size as tables supplied by Subcommittee. Questions
about the survey should be directed to Phineas Indritz, Subcommittee chief
counsel, or to Gerald S. Schatz, Subcommittee professional staff member.
1. Definitions.
As defined in paragraph 4, Bureau of the Budget Circular No. A-78
("Air pollution from Federal activities," August 6, 1966):
The term "Federal installation" includes all buildings and
facilities owned by the Federal Government, whether or not
they are operated by an agency of the Federal Government.
It excludes buildings or facilities leased in whole or in
part by the Federal Government except where an agency head
determines in consultation with the Secretary of Health,
Education, and Welfare that exclusion of such buildings would
seriously impair his ability to carry out his responsibility
to abate pollution resulting from Federal activities.
For purposes of this survey, the Subcommittee--unlike BOB Circular
A-78--includes as Federal installations the buildings and facilities of the
District of Columbia Government. The terms "installation," "in the United
States," and "cost" are used as set forth in BOB Circular A-78, paragraph 4:
An "installation" is defined as the same reporting entity
used in the Annual Real Property Inventory reported to
General Services Administration pursuant to Federal Property
Management Regulations, subchapter A, part 101-3. Installa-
tions "in the United States" include those in the 50 States,
the District of Columbia, the Commonwealth of Puerto Rico, the
Virgin Islands, Guam and American Samoa. The "cost" of
remedial measures is that amount which must be specifically
provided for in the budget for the purpose of taking such
measures. This generally will.- mean capital cost of equip-
ment and cost of installation, but not maintenance and
operating costs.

2. Compliance or noncompliance with Federal standards.
Federal standards are those prescribing air pollution abatement
practices and emissions levels established by the Secretary of Health,
Education, and Welfare in 42 C.F.R. Part 76 and published in 31 Federal
Register 7902 (June 3, 1966) as amended, 32 Federal Register 4415 (March 23,
1967), and, pursuant to sec. 76.3(b), include the standards, abatement prac-
tices, and emissions levels prescribed by local agencies if they are more
stringent than the Federal standards. Because the Secretary of Health,
Education, and Welfare on April 4, 1969, proposed (34 Federal Register 6122)
to eliminate paragraph (3) of sec. 76.4, requiring a smoke detector, recorder,
or alarm, and to eliminate the phrase in sec. 76.8(b) restricting particle
size to 60 microns, disregard these requirements in determining whether a
facility was in compliance with Federal standards as of April 1, 1969.
3. Exemptions.
"Exemptions" from abatement requirements are those granted by the
Secretary of Health, Education, and Welfare pursuant to section 4(i) of
Executive Order 11282 ("Control of Air Pollution Originating from Federal
Installations," May 26, 1966).
4. Scope of survey.
Tables I-A-1 through I-A-6 and I-B-1 through I-B-6 call for an
installation-by-installation listing of all installations, whether or not
reported to the Bureau of the Budget pursuant to BOB Circular A-78, with
one or more facilities meeting any of the following criteria:
--Facilities, including places of open burning, are of size
and type subject to emissions limitations and air
pollution abatement practices required by Federal
standards as defined hereinabove.
--Facilities on April 1, 1969, were not in compliance with
Federal standards as defined hereinabove.
--Facilities on April 1, 1969, were under exemption by action
of the Secretary of Health, Education, and Welfare or
exemption was being sought.
--Facilities were to have been reported to the Bureau of the
Budget pursuant to BOB Circular A-78 on or before
July 1, 1969.

Tables I-A-1 through I-A-6 and I-B-1 through I-B-6 are organized
by Air Quality Control Region. Totals from these tables are to be used in
filling out Table I, a summary by region.
Table II calls for information on fuel shifts and anticipated changes
in fuel consumption only by those installations that as of April 1, 1969, were
planning fuel shifts expected to result in abatement of air pollution. This
table calls for totals resulting from such changes by all such installations
in the United States. Do not list such installations.
5. Special instructions for filling out Tables in I-A and I B series.
Information should be given for installation, not for each separate
facility. Column 1 in the Table I-B series is to be identical to Column 1 in
the Table I-A series. List installations alphabetically. Columns requiring
other than quantitative information are to be filled in according to the
examples below.

Column 2, "Emissions sources." Describe briefly, e.g.:
255 coal-fired furnaces,
1 open-burning dump,
3 hand-fired incinerators,
1 500-MW power plant.
Columns 5, 6, "Installations exempted . . . ." Indicate
with an "X" ifinstallation is exempted, then
show total number of such answers in totals.
Columns 7, 8, "Installations not in compliance
Indicate with an "X" if installation not in
compliance with Federal standards as defined
hereinabove, then show total number of such
answers in totals.
Column 9, "If installation not in compliance, cite appli-
cable standard(s)." Briefly cite standard and
jurisdiction, e.g..
"Rule 22, Los Angeles County APCD" or
"Sec. 76.8 of 42 C.F.R."

A survey of point sources of air pollution emitting more
than 100 tons annually of any single pollutant from 1965-1966
has the Central Intelligence Agency in northern Virginia emit-
ting more than 500 tons annually of several pollutants.

Government Information and Fore: Operations Subcommittee, staff,
and discussed with him a complaint received by the Subcommittee con-
cerning classification of an item appearing in the Technical Abstract
Bulletin published by the Defense Documentation Center, Defense Supply
Agency. It was reported that the item was classified by the Central
Intelligence Agency. After some discussion it was suggested that due to
Chairman Moss' strong personal interest in classification of foreign docu-
ments a meeting be scheduled for Mr. Maury with the Chairman after the
Chairman's return to the city (see Memorandum for the Record).

SUBJECT: Inquiry from Representative John E. Moss
(D., Calif.) - Soviet Publication Voyennaya
Mys; (Military Thought) for November 1968
1. In response to a call from Mr. Matteson, House Government
Information and Foreign Operations Subcommittee staff. I met with him
and reviewed the committee file on a complaint received by the Chairman
concerning classification of an item listed in the Technical Abstract
Bulletin published by the Defense Documentation Center, Defense Supply
Agency. The complainant noted in his letter that he had recently noticed
a trend toward classification of translations from Russian books and
publications and cited bulletin No. 69-3. Mr. Matteson requested that
the complainant's name not be cited even though he had provided the
complete file for my review. He furnished a copy of the Chairman's
letter to the Secretary of the Navy (attached) for background information.
2. I advised Mr. Matteson that I was familiar in general with

that it is published in three versions which are classified by the Sov -k-0-
Mr. Matteson was interested in whether classification by the Agency is
related to the content of the subsequent translation (which in this instance
was by the Navy Department) or solely to protect the source of this Soviet
publication. I advised that our classification would be for protection of
source. On a personal note, Mr. Matteson expressed interest in the
question whether the Soviet Embassy might not have access to the Tech-
nical Abstract Bulletin through normal publication channels and, if so,
12..,,2lAn't they then be apprised of the fact that we are able to acquire.
3. We discussed at some length Chairman Moss' very strong
personal interest in 'love rclassification" by the Executive Branch. Even
though Mr. Matteson foresees no further official question on this particular
matter, he agreed that it would be well to schedule a meeting for Mr. Maury
with Representative Moss on his return to the city.

House Manpower and Civil Service Subcommittee staff, who advised that
Chairman Henderson's draft bill on constitutional rights of Govern-
ment employees has not been scheduled as yet for introduction to the
House. He noted that the Chairman in all probability will be meeting
with Senator Ervin (D., N. C.) again before such introduction would
take place. He also noted that interest in the bill and demands for

called in connection with my earlier inquiry and reported that the Foreign
Service Association Hospital Plan will be amended effective 1 January 1970
to place overseas and domestic Foreign Service personnel on the same
footing with respect to' reimbursement under the medical insurance plan
and the overseas medical statutory benefit program. This will place the
Foreign Service plan into major compliance with the suggestions of the
Comptroller General's report and will involve probably a 20 percent increase
in premium costs. Mr. C. W. Fall, Jr., who is with the Foreign Service
Protection Association has further details. This information was passed
on to Personnel .

13. Ernest C. Baynard, Staff Director,
Government Activities Subcommittee and principal advisor to Rep. Jack
Brooks on ADP matters, called in connection with an. ADP standards
Board of Review which has been operating for some eight months now under
the aegis of the National Academy of Science and funded by ARPA and chaired
by Ottinger of Harvard. Baynard said he had been invited to attend some of
the meetings, felt that the Board's work was unnecessarily duplicative of
the responsibilities of the National Bureau of Standards and Executive agencies,
and thus a waste of time and money. He said he felt he was only seeing part
of the iceberg and believed there were a number of sessions to which he was
not being invited and which he believed dealt in part with computer export
and national security interest. Baynard was obviously on a.fishing expedition
and we are under no, obligation to reply.

At the DCI staff meeting this morning Mr. Bross mentioned
a Congressional letter to Mr. Laird concerning the planned DOD
computer buy for the Command asW Control System.
2. The memorandum wk_.s signed by Representative Jack Brooks
who is chairman of the Govern6ent Activities Subcommittee of the
House Committee on Government Operations. Representative Brooks
has no previous training or experience in the computer field but has
selected this as his area of particular interest in government operations.
3. Representative Brooks makes the following points in his

of all aspects of computer procurement--requirements,
validation, coordination, etc. --in a program which will reach
500 million dollars over five years.
There has been no valid feasibility study or evaluation
of the equipment now in use.
Procurement should be Eer syste design and develop-
ment, not before.
There is no indication that the new proposed systent
will be any better than the old. No satisfactory data manage-
ment package has yet been designed for the old system. These
management packages are now designed after the system is in--
not before, as they should be.
This five-year program is a "brute force" method to
achieve compatibility and to get away from "sole source" from
IBM. It is an interim p rograrn while waiting for development
of better hardware and systems--is, it necessary?

4. The computer people at DIA agree with the Brooks letter.
They have been trying for some time to get disengaged from the
program since it slows them up and presents unnecessary problems.

This Subcommittee has devoted considerable effort over the years to
advancements . in the rcianagcment and ixtilizatioc of computers in'Govern= t .
ITncler Public Law 89-305, the Executive 33ranch is ,structuring a 'Government-
: wide business-like rrianagemert system for computers under the policy direc-
tion of the Bureau of the Budget, but. with operational responsibilities
loci ;ed in the General Services Administration and the Nationa3. Bureau of
nn a nuraber of occasions the Subcommittee has intervened, either . ?
directly or through the Bureau of the Budget or GSA, when it became apparent
'that the course of ?some,particular computer. selection was ill-advised. Oa.:
May 24; 19668, 1: wrote then Secretary of Defense Clark Clifford about plans
of the Department to update the so-called "World-Wide Ccrnmand and Control
Computer System." At that time, we recorranended that this large computer
procurement might be segmented to allow for the purchase of canputers of
various manufacturers. Our interest in this goal is as strong as ever.
Rowever, over the past several months, as the Subcommittee has sought to
obtain additional information concerning this proposed procurement, a number
of other questions have arisen. For purposes of economy and efficiency,.
these questions merit consideration prior to finalization of this procurement,
.rather than after fipm commitments have been made.
These questions and areas of concern are as follows :
].: Despite the magnitude of the proposed expenditure, there
is no one office or individual in the entire ' departient, to the
Subcommittee =s knowledge, having overall. jurisdiction over the
processing of this proposed procurement. Over a period of several

Yet, it is apparently the decision '.of the Department .to select and
acquire hardware in anticipation of 'system development under this pro-
curement . Only the most definitive and persuasive reasons should albw
this procurement to be an exception to what otherwise has become a
generally-accepted rule in efficient computer system procurement

leading.
These are some of the questions the Subcorwai.ttee has concerninz this
particular procuremnt. They are questions of laymen and not t 'se of cc~-iiputer
experts. On the other hand, they are questions which the Subcommittee con-
siders pertinent and material, and to which we-have been unable to obtain
'appropriate 'answers from the Department. These questions do not reflect ?ary?,
