My dear Mr. Dulles:
This refers to the draft Executive order headed "Delegating
certain authority under the Atomic Energy Act of 1954, as amended,"
which was transmitted to the President by the Deputy Secretary of
Defense and the Acting Chairman of the Atomic Energy Commission on
September 4, 1958, and to subsequent correspondence relating to
that proposed order.
I transmit herewith copies of the following: (1) Revised draft
Executive order, as transmitted to the Attorney General, (2) trans-
mittal letter to the Attorney General, and explanatory attachment
thereof, and (3) correspondence from the Chairman of the Atomic Energy
Commission, dated April 2, 1959, and from the Department of Defense,
dated March 11, 1959 (copies of the AEC and Defense Department papers
have heretofore been made available to your staff, informally).
As is explained in the documents referred to above, the trans-
mitted Executive order draft omits provisions with respect to the
communication of Restricted Data for intelligence purposes (originally
proposed by the Central Intelligence Agency), but otherwise leaves
that matter open.
It seems to us that any proposed general Presidential author-
ization for your Agency to communicate Restricted Data for intelli-
gence purposes should, if possible, have the concurrence of the
Department of Defense, the Department of State, and the Atomic Energy
Commission. Accordingly, should you desire to pursue this matter
further, we suggest for consideration that you initiate the develop-
ment of such a proposal.
