Declassified and Approved For Release @ 50-Yr 2014/01/08: CIA-RDP60-00321R000300180003-7 84TH CONGRESS H D 755 1ST SESSION IVO eal IN THE HOUSE OF REPRESENTATIVES FEBRUARY 8, 1955 Mr. DAWSON of Illinois (by request) introduced the following bill; which was referred to the Committee on Government Operations A BILL To amend the Federal Property and Administrative Services Act of 1949, as amended, and for other purposes. 1 Be it enacted by the Senate and House of Represent a- 2 tives of the United States of America in Congress assembled, 3 That the Federal Property and Administrative Services Act 4 of 1949, as amended, is hereby further amended as follows: 5 (a) By designating subsection (g) as subsection (h) 6 and by adding a new subsection (g) to section 506 to read 7 as follows: 8 (g) (1) The head of any Federal agency may author- 9 ize the destruction of any records under his jurisdiction 10 beyond the continental limits of the -United States, including 11 those pertaining to Government contracts required to be Declassified and Approved For Release_ @ 50-Yr 2014/01/08: CIA-RDP60-00321R000300180003-7 Declassified and Approved For Release @ 50-Yr 2014/01/08: CIA-RDP60-00321R000300180063-7 2 1 retained in the custody of any person, pursuant to regula- 2 tions that he shall issue permitting the destruction of such 3 records when their retention would imperil the security or 4 be prejudicial to the interests of the United States, because 5 of the existence either of a state of war or the imminence 6 of hostile action at the place where the records are located. 7 "(2) The head of any Federal agency may authorize. 8 the destruction of any records under his jurisdiction located 9 within the continental limits of the United States including io those pertaining to Government contracts required to be retained in the custody of any person, pursuant to regulations 12 that he shall issue permitting the destruction of such records 13 when their retention would imperil the security of the ,United 14 States, because of the imminence of hostile action at the place 15 where the records are located. 16 "(3) Subsequent to such destruction a written report 17 shall be made to the Administrator by the head of any 18 Federal agency who has custody of the records destroyed 19 under this subsection in accordance with regulations issued 20 by the Administrator with due regard to the program activi- 21 ties of the agency concerned." 22 (b) By striking out the word "and" at the end of para- 23 graph (32) of subsection (a) of section 602, striking out the 24 period at the end of paragraph (33) of said subsection and Declassified and Approved For Release @ 50-Yr 2014/01/08: CIA-RDP60-00321R000300180003-7 Declassified and Approved For Release @ 50-Yr 2014/01/08: CIA-RDP60-00321R000300180003-7 3 1 inserting in lieu thereof a new semicolon, and adding at the 2 end of said subsection the following new paragraph: 3 "(34) Section 11 of the Act entitled 'An Act to provide 4 for the disposal of certain records of the -United States Gov- 5 ernment', approved July 7, 1943 (57 Stat. 382, as amended, 6 44 U. S. C. 376)." 7 (c) By amending the Contract Settlement Act of 1944 8 (58 Stat. 649, 667, as amended, 18 U. S. C. 443) , by 9 inserting the following language after the word "appro- 10 priate", in the third line of the second paragraph of said 11 section: "notwithstanding any provisions included in the 12 individual contracts or subcontracts regarding periods of 13 retention of records".
