RES. 193 IN THE HOUSE OF REPRESENTATIVES FETRUARY 3, 1955 Mr. FLOOD introduced the following joint resolution; which was referred to the Committee on Education and Labor JOINT RESOLUTION provide for a commission to make available information as to the basic differences between the theories and practices of the American way of life and the theories and practices of atheistic communism. 1 Resolved by the Senate and Roic>se of Representatives 2 of the United States of America in Congress assembled, 3 ESTABLISHMENT OF TILE COMMISSION 4 SECTION 1. (a) There is hereby established a commis- 5 sion to be known as the Commission To Make Availabhk 6 Information as to the Basic Differences Between the Theories 7 and Practices of the American Way of Life and the The- 8 ones and Practices of Atheistic Communism (in this joint; 9 resolution referred to as the "Commission") . Approved For Release 2000/08/17 : CIA-RDP59-00224A000100280004-1 Approved For Release 2000/08/17 : CIA-RDP59-00224A000100280004-1 2 1 (b) The Con mission shall be composed of eleven mem- 2 bers as follows : 3 (1) Two members from the Senate of the United 4 States, appointed by the President of the Senate; 5 (2) Two members from the House of Representatives, 6 appointed by the Speaker of the House; 7 (3) Three members appointed by the President from 8 among individuals each of whom is a member of the Stand- 9 ing, Committee on American Citizenship of the American 10 Bar Association, and who have been nominated by the 11 Board of Governors of the American Bar Association; 12 (4) Three members appointed by the President from 13 among individuals each of whom is a member of the Associa- 14 tion of American Colleges or the American Council of Edu- 15 cation, and who have been nominated by the respective 16 governing boards of those organizations; and 41 (5) One member appointed by the President from 18 private life, to be Chairman of the Commission. 19 (c) Any vacancy in the Commission shall not affect 20 its powers, but shall be filled in the same manner in which 21 the original appointment was made. 22 DITTIES OF THE COMMISSION 23 SEC. 2. The Commission- 24 (1) shall make a study of the testimony relating 25 to the theories and practices of atheistic communism Approved For Release 2000/08/17 : CIA-RDP59-00224A000100280004-1 Approved For Release 2000/08/17 : CIA-RDP59-00224A000100280004-1 3 1 which, since the end of World War II, has been taken 2 under oath by the Internal Security Subcommittee of the 3 Senate Judiciary Committee, the House Committee on 4 Un-American Activities, the House Select Committee 5 To Conduct an Investigation of the Facts, Evidence, and 6 Circumstances of the Katyn Forest Massacre, the House 7 Select Committee To Investigate Communist Aggres- 8 sion and the Forced Incorporation of the Baltic States 9 Into the U. S. S. R., and by any other standing com- 10 mittee of the Senate or House of Representatives, and 11 by any agency in the executive branch of the United 12 States Government; and on the basis of its study, shall 13 prepare material for a book, incorporating only testi- 14 mony taken under oath by the committees and agencies 15 referred to above, selected so as to give the fullest pos- 16 sible information as to the theories and practices of 17 atheistic communism; and 18 (2) shall prepare suggested curricula of studies, 19 suitable for use in the teaching of courses in schools, 20 colleges, and universities, which will make clear the 21 basic differences between the theories and practices of 22 the American way of life and the theories and practices 23 of atheistic communism, and for this purpose it shall be, 24 the duty of the Commission to review all pertinent data 25 available to it. Six members of the Commission shall constitute 3 a quorum. 4. COMPENSATION OF MEMBERS OF THE COMMISSION SEC. 4. (a) Members of Congress who are members 6 of the Commission shall serve without compensation in 7 addition to that received for their services as Members of 8 Congress; but they shall be reimbursed for travel, subsistence, 9 and other necessary expenses incurred by them in the per- 10 formance of the duties vested in the Commission. 11 (b) The members from private life shall each receive 12 $50 per diem when engaged in the actual performance of 13 duties vested in the Commission, plus reimbursement for 14 travel, subsistence, and other necessary expenses incurred 15 by them in the performance of such duties. 16 STAFF OF T111] COMMISSION 17 SEC. 5. The Commission shall have power to appoint 18 and J 'lx the compensation of such personnel as it deems ad- 19 visable, without regard to the provisions of the civil-service 20 laws and the Classification Act of 1949, as amended. 21 EXPENSES OF THE COMMISSION 22 SEC. 6. There is hereby authorized to be appropriated, 23 out of any rnon.ey in the Treasury not otherwise appropriated, 24 so much as may be necessary to carry out the provisions of 25 this joint resolution. To the extent necessary in order to enable the Commission to carry out the purposes of this joint resolution, 4 the Commission shall be permitted to have access to the 5 records and data of committees and agencies referred to in 6 section 2. 7 APPLICABILITY OF CERTAIN LAWS 8 SEC. 8. Service of an individual as a member of the 9 Commission or employment of an individual by the Commis- 10 sion as an attorney or expert in any business or professional 11 field, on a part-time or full-time basis, with or without corn- 12 pensation, shall not be considered as service or employment 13 bringing such individual within the provisions of section 281, 14 283, 284, 434, or 1914 of title 18 of the United States Code, 15 or section 190 of the Revised Statutes (5 U. S. C. 99) . 16 REPORTS 17 SEC. 9. Upon completion of its work, but not later than 18 December 31, 1955, the Commission shall submit to the 19 President a report containing the text book and curricula 20 of studies referred to in section 2. Not later than March 1, 21 1956, the President shall submit the Commission's report 22 to the Congress, together, with such comments and recom- 23 mendations as he deems advisable. The Commission shall cease to exist on the 3 thirtieth day following the date on which the President 4 submits the Commission's report to the Congress.
