SUBJECT:
1. Reference is made to memora u of 1 March 1948
25X1A to the General Counse from Captain regard-
ing claim against the Company for conceallgX1A
damages to shipment from 25X1A
2. Investigation of'this claim discloses:
(a) That the equipment was procured on
Purchase Order 5708-Al FOB point destination;
(b) That title to the equipment presumably
passed to the Government at this point, subject
to its usual right of inspection;
(c) That upon exercising its right of in-
spection, concealed damages were discovered which
the Contractor acknowledged to be a not infrequent
occurrence due to the extremely sensitive nature
of the equipment;
25X1A (d) That represen-
tativeg has caused the damaged equipment to be
repaired,and th2tX Aquipment is now in use;
(e) That does not wish to pursue
any claim it may have against the carrier, for
which reason it considers the case closed.
