A-8 Revised TO THE BEADS OF PX CUTIVE DEPARTMENTS AND ESTABLISHMENTS SUBJECT: Allowances payable to Federal officers and employees stationed in foreign countries Pnrnose. This revision of Bureau of the Budget Circular No. A-8 provides for the payment of quarters and cost of living allowances to civilian personnel stationed in foreign countries. Effective the first pay period beginning after June 30, 1946, personnel temporarily stationed abroad who were formerly paid living and quarters allowances shall be paid instead quarters and cost of living allowances under these regulations. This revision of Circular No. A.-8 replaces and rescinds: (1) Circular No. A-8 dated August 1, 1943, containing Parts I and II; (2) the Supplement to Circular No. A-8 dated January 11, 1944, containing Part III; (3) the Amendment to Circular No. A-8 dated February 11, 1946; and (4) Appendices I to V inclusive and their amendments issued prior to this revision. . This revision of Circular No. A-8 consists of Parts A and B, the regulations governing payment of quarters and cost of living allowances respectively; Appendices I and IT, the classification of posts for and schedule of quarters allowances; Appendices III and IV, the classification of posts for and schedule of cost of living allowances; and Appendix V. special foreign living allowances. Hereafter, changes in Parts A and B, below, concerning quarters and cost of living allowances will be issued by a complete revision of the Circular or as amendments to the Circular. Changes in the classification of posts for these allowances will be issued as Bureau of the Budget Bulletins. Complete lists of post classifications will be issued at the beginning of each fiscal year and possibly at more frequent intervals. Definitions. For the purposes of this Circular: a. "Quarters allowance" Includes rent, heat, fuel and light. b. "Cost of living allowance" is an allowance to an employee to equalize the difference between costs at the foreign post and Washington, D. C., of subsistence, services, commodities, and other living expenses, except quarters (including heat, fuel and light). c. "Employee" is a civilian officer or employee of the United States Government. "Family" means the mother, father, children, stepchildren or sister of a married or unmarried employee living with the employee at the foreign ;post. e. "Department" is any executive department, independent commission, office or agency or government-owned or controlled corporation, or other establishment of the Government. f. "He,adof department" includes such persons as he may designate to carry out the provisions of this Circular. Part A: Standardized Regulations to Govern Allowances for Living Quarters, Heat, Fuel and Light for Civilian Officers and Employees of the Government Stationed in Foreign Countries. Except as otherwise noted, the provisions of Part A have been effective since July 1, 1931. 1. Authority. The Act of June 26, 1930 (46 Stat. 818) provides: "That under such regulations as the heads of the respective departments concerned may prescribe and the President approve, civilian officers and employees of -the Government having permanent station in a foreign country may be furnished, without cost to them, living quarters, including heat, fuel, and light, in government-owned or rented buildings, and where such quarters are not available, may be granted an allowance for living quarters, including heat, fuel, and light, notwithstanding the provisions of section 1765 of the Revised Statutes (U.S.C., title 5, sec. 70): Provided, That said rented quarters or allowances in lieu thereof may be furnished only within the limits of such appropriations as may be made therefor, which appropriations are hereby authorized: Provided further, That the provisions of this Act shall apply only to those civilian officers and employees who are citizens of the United States." 2. Rental of buildings. Unless otherwise provided by law, the rental by the Government of living quarters for civilian employees having permanent station in a foreign country will be restricted to buildings rented by the Secretary of State. 3. Availability of Government quarters. Employees will be expected to reside in government-owned or rented buildings unless the head of the department concerned shall determine that suitable living quarters are not available. 4. Basis of quarters allowance. The basis of the quarters allow- ances shall be the: (1) classification of posts with respect to the relative cost of rent, heat, fuel and light; (2) rank or status of the officer or employee; and (d) family status (other than chiefs of mission Approved For Release 2002/07/31 : CIA-RDP54-00177A000200050163-7 (No. A-8) Approved FRelease 2002/07/31 : CIA-RDP54-001A000200050163-7 in the State Department), as defined above. Where two or more members of`a family living together are employed by the Government either in the same or different offices or capacities, the allowances granted such persons shall not in total exceed the maximum which might be granted to a married employee. (Effective September 1, 1936) 5. Classification of -posts. Foreign posts have been classified according to the relative cost of rent, heat, fuel and light. The classi- fication of foreign posts, Appendix I, is attached and made a part of this Circular. Application for additions to the classification of posts should be made to the Secretary of State. So far as practicable classifications of posts will be on a fiscal year basis. 6. Classification of EoYees. Employees shall be classified in four groups and within each group (except group 1) according to family status as defined above. The four groups shall be: Grow 1: Chiefs of mission, State Department. Gram 2: In a diplomatic mission, the counselors of embassy or legation or the senior first secretary acting as counselor; or, if there is neither a counselor of embassy or legation nor a senior first secretary acting as counselor, then the highest ranking diplomatic secretary. At a combined office, the counselors of embassy or legation or the senior first secretary acting as counselor and the consul general, pro- vided that if only one Foreign Service officer is assigned to a combined office in any of the foregoing categories, then the second highest ranking diplomatic secretary or consular officer shall also be classified in this group; and provided further that if no Foreign Service officers are assigned to a combined office in any of the foregoing categories, then the two highest raddng diplomatic secretaries or consular officers at the post shall be classified in this group. In both diplomatic missions and combined offices, all Foreign Service officers assigned as counselors for economic affairs, agricultural attaches, and commercial attaches. Foreign Service officers in charge of consular posts and vice consuls commissioned by the Secretary of State who are in charge of consulates. Attaches, who are neither Foreign Service officers nor vice consuls commissioned by the Secretary of State; commissioners; supervising agents; and technical and professional experts directly subordinate to their departments in Washington. A-8) Approved For Release 2002/07/31 : CIA-RDP54-00177A000200050163-7 employees-designated as administrative officers; assistant commissioners; inspectors; immigration technical advisers; treasury representatives; customs agents and deputy collectors of customs; technical and professional experts not directly subordinate to their departments in Washington, and junior technical experts. (Effective July 1, 1944) Gro= 4: All other employees. (Effective July 1, 1944) 7. Amounts allgrable. Allowances in lieu of quarters in kind shall be made by the head of the department within the maximum rates established in accordance with paragraphs 4, 5, and 6, above. These rates, Appendix II, are attached and made a part of this Circular. 8. Revision _of allowances during the Year. An allowance will not be, revised during the fiscal year except for change in the marital or family status, official position or assignment, change in post classification or except in case of expiration of a lease or determination by the department concerned that quarters occupied are not. suitable or that suitable Government quarters are available. 9. tMe hod of computing allowances. Effective July 1, 1945, allowances shall be on a fiscal year basis, payable bi-weekly on the basis of 14 days. They shall be computed in accordance with the following provisions$ a. The allowance to an employee who is at his post of duty, or only temporarily absent therefrom having previously entered upon his duties there, will begin on the date fixed by the head of the department. b. The allowance to a newly appointed or transferred employee will begin at the new post on the date of arrival. (Effective first pay period beginning after June 30, 1946) e. The allowance to an employee resigning, dismissed, transferred or retiring shall be discontinued the end of the last day he is on duty at the post. (Effective date same as b., above) d. The allowance to an employee advanced temporarily from a subordinate position to a position in charge of an office shall not be increased while the principal officer is absent on leave or under orders. However, upon transfer of the principal officer, the head of the department may increase the allowance for not to exceed the period in charge, which shall be considered as beginning and ending as of the next succeeding pay period. (Effective date the same as b., above) e. Increases or decreases in allowances on account of change in official or family status shall be effective the first pay period beginning after the date of change. (Effective date the same as b., above) f. An allowance may be paid: (1) for not to exceed 90 days during authorized leave of absence with pay, plus transit time when leave is Approved For Release 2002/07/31 : CIA-RDP54-00177A000200050163-7 (No. A-8) Approved F'b4''"Release 2002/07/31 : CIA-RDP54-001``WA000200050163-7 taken in the United States; (2) while temporarily absent under order from post of assignment; or (3) during the period of absence from regular post of assignment without pay on account of illness or beyond the period specified above of leave with pay, provided the head of the department is satisfied and so determines that said continuance would be in the public interest, and provided that in each of the above cases the employee continues to maintain and pay for his quarters at his regular post. 10. Payment of allowances. Payment of allowances for quarters, heat, fuel and light will be made on Standard Form No. 1069 Revised, "Voucher for Allowances at Foreign Posts of Duty." Part B: Standardized Regulations to Govern the Payment of Cost of Living Allowances to Certain Civilian Officers and Employees of the Government Stationed in Foreign Countries. Except as otherwise noted, the provisions of Part B have been effective since February 1, 1944. 11. Authority. The Act of February 23, 1931 (22 U.S.C. 12) provides: "That under such regulations as the President may prescribe, and within the limitations of such appropriations as may be made therefor, which appropriations are hereby authorized, ambassadors, ministers, diplomatic, consular, and Foreign Service officers may be granted * * * post allowances ? wherever the cost of living may be proportionately so high that in the opinion of the Secretary of State such allowances are necessary to enable such diplomatic, consular, and Foreign Service officers to carry on their work efficiently * * * ." Section 304 of the Act of December 23, 1943, and subsequent appropriation acts extend these benefits to employees of all other departments. 12. Scove of thes_rei ations. When authorized or approved by the head of the department, cast of living allowances are payable to employees who are being furnished quarters or receiving allowances in lieu thereof under Part A of this Circular and who are. stationed at foreign posts for which cost of living allowances are provided (Appendix IV). The following employees are excluded: (a) Personnel of the Foreign Service of the United States; (b) non-citizens of the United States; and (c) employees who may be determined by the head of the department concerned to be ineligible for cost of living allowances because no higher costs for subsistence, services, commodities, and other living expenses, except quarters (including heat, fuel and light) are occasioned by their assign- ments in a foreign country. 13. Basis of allowances. The schedule of cost of living allowancei, Appendix III, is attached and made a part of this Circular. New schedules will be issued from time to time, as necessary. Where circumstances are such that the amount otherwise payable at a particular foreign post does not accomplish the purpose for which cost of living allowances are pre- scribed, application should be made to the Director of the Bureau of the Budget for the establishment of a special allowance. The special allowances, Appendix Y, are attached and made?a part of this Circular. 14. Classification of vosts. The foreign posts at which the cost of living is higher than at Washington, D. C., are determined and classified on the basis of the relative cost of living. by the Secretary of State pursuant to the Act of February 23, 1931 (22 U.S.C. 12). The classification of such posts, Appendix IV, is attached and made a part of this Circular. Posts are added and the classification of posts revised periodically, as necessary. Effective July 1, 1945, such additions and changes are effective the first pay period beginning after the last day of the month in which the determination is made. Requests for the classification of new posts shall be made to the Secretary of State. 15. Method of comvutinR allow azces. Effective July 1, 1945, the allowances shall bo on an annual basis, payable bi-weekly on the basis of 14 days. They shall be computed in accordance with the following provisions: a. An employee shall receive a cost of living allowance from the date of his arrival at his official station at a foreign post or the date the post is designated as his official station, whichever date is later. b. The cost of living allowance to an employee resigning, dismissed, retiring or transferred to another official station shall terminate at the end of the last day he is on duty at the post. In the case of transfers, no allowance shall be paid at the new post unless specifically authorized or approved. e. An, employee shall receive a cost of living allowance while on sick leave with pay and while on annual leave but*not during leave taken in the United States nor while on leave without pay. d. An employee with family shall receive a cost of living allowance while away from his post of duty in a travel status. An employee without family shall not receive the allowance for any portion of a trip of more than 24 hours duration. E. Increases and decreases in allowances on account of change in salary or family status shall be effective the first pay period beginning aftar the date of change. Where specifically authorized or approved, quarters allowances, cost of living allowances, or special foreign living allowances shall be paid to those employees having permanent station in a foreign country.
