Summary
The Act of. Buenos Aires, signed in February.1964, was proclaimed as
facilitating Paraguay's. access to the sea by easing Argentine' restrictions
on the use of the Parand River. This airgram summarizes the recent events
leading up to,the Argentine suspension of the Act of Buenos Aires on
July 22. The immediate economic effect of the denunciation on Paraguayan
river commerce is negligible as neither of the two. important features
of the Act, i.e., use of Paraguayan pilots on Paraguayan vessels, and
amplification of free port facilities in Buenos Aires, had been realized.
Politically the Argentine action represents the renewed salting of old
wounds. The incident also represents a trial for Paraguayan Foreign
Minister SAPENA Pastor, already under attack for the Foreign Ministry's,.
handling of the affair.,

Background
The Embassy's airgram referred to above, and the previous reports referenced
therein, report the prolonged story of Paraguay's attempts to obtain recognized
and unrestricted access to the sea from the Argentines. The most recent act
of this century-long drama commenced with the signing of the Acta de Buenos Aires
on February 7, 1964. The drawn-out negotiations necessary to implement this act,
and the Paraguayan dissatisfaction with the eventual Argentine implementing
regulations, have constituted a continuing source of frustration for the Paraguayan
Foreign Ministry.
The recent developments leading to the current impasse had'their origin
when Argentine port authorities at Corrientes stopped one Paraguayan vessel,
on May 24 and another on May 31. After some hours of delay while the Argentines
inspected the ships' papers and cargo the vessels were allowed to proceed to
the port of Asunc16n. Both of the vessels belonged to the Paraguayan State
Merchant Fleet (Flota Mercante del Estado).
In a press conference on June 5 Sr. Vidal BEDOYA, the Administrator of
the State Merchant Fleet, was reported as decrying the."abusive attitude of the
Argentine authorities which constitute a flagrant attack on the principle of
free navigation." He maintained that "A vessel which has sailed from an
Argentine port with the required documentation cannot be detained or delayed
under any pretext, and not in any case to check cargo in transit-destined to
an international port, which is the case of the vessels of our fleet which
travel from Rio de la Plata to Asunc16n." Foreign Minister Sapena Pastor
described the Argentine action as "truly arbitrary and an abuse" and announced
that he had directed the Paraguayan Ambassador in Buenos Aires to express the GOP's complaint to the Argentine Foreign Office.
The Paraguayan note was delivered on June 10. On June 15 the. Argentine
reply was given to the Paraguayan Ambassador. The Argentines asserted their
authorities deemed it necessary to verify that the Paraguayan? vessels still
included in their cargoes large quantities of foreign cigarettes taken aboard
in Buenos Aires. The Argentine note proceeded to specify incidents in which
cigarettes consigned to Asunc16n firms had been smuggled into Argentina and
affirmed that the detentions resulted as a legitimate exercise of its police
powers. The text of the Argentine note is. transmitted as enclosure (1).
The Argentine note brought a prompt and impassioned response from the
Administrator of the Paraguayan Merchant Fleet. In a letter directed to
Foreign Minister Sapena Pastor and released to the local press, Fleet
Administrator Bedoya rejected what he described as the unjustified allegations
of the Argentine reply. Denying that vessels of the Merchant Fleet were involved
in contraband he charged that under private law the Argentine statements would
be criminal defamation. The text of Sr. Bedoya's statement is transmitted.as
enclosure (2).

The Foreign Minister privately took a somewhat less adamant line on the
matter. In a conversation with our Charge at the time he indicated that he
was less than satisfied with the Fleet's response and that he-did not reject
so categorically the allegations that the Fleet might be involved in
contraband activities. He did maintain, however, that the cargo operations of
the Fleet were not the concern of the Argentine authorities.
The Paraguayans responded to the Argentine note on June 30. However
strong Sapena Pastor's personal doubts on the integrity of the Fleet there.. is
little evidence of moral uncertainty in.the Paraguayan reply which describes
the Argentine actions as "unnecessarily rigorous" and "characterized by
arbitrariness." Further, it was stated that the GOP "would not recognize the
application of measures, however legal in Argentina, which tended to restrict
Paraguay's right' of communication, navigation, and transportation ,via the Paran&/
to and from Paraguay." The text of the Paraguayan note is transmitted as
enclosure (3).
Of little relevance but of direct importance to the larger issue was the
annual visit of the Argentine War College to Asuncion during the last week of
June. In their. customary interview with President Alfredo STRQESSNER on
June 30, which was reported in unusual detail in the Colorado Party newspaper,
Patria, the President repeated the standard Paraguayan complaint against
the connivance of the Argentine military' in the guerrilla raids on Paraguayan
territory by exile groups (1959-1960). Specifically mentioning General
Carlos TORANZO Montero and other Argentine military chiefs involved, President.
Stroessner stated that although they are anti-communists they nevertheless
promoted the infiltration of communism into Paraguay. It subsequently became
apparent that the President's remarks were not well received in Argentina.,
Argentine Suspension of-the Act of Buenos Aires
On July 22 Argentina delivered its response to the Paraguayan note of
June 30. The note, delivered in Buenos Aires, restates Argentina's claim to
sovereignty over the Parana River. It notes that the Act of Buenos Aires had
granted Paraguay its objectives; the use of Paraguayan pilots on Paraguayan
vessels and greater free trade zone facilities in Buenos Aires. It expresses
surprise that the Paraguayans objected to the GOA's exercise of its police
powers to such an extent that it would not recognize measures, legal in
Argentina, which tended to restrict Paraguay's river navigation rights. Further,
that such an attitude would lead a Paraguayan vessel to refuse to embark an
Argentine official. The Argentine note also expresses concern over statements
made at "high levels" of the GOP casting.aspersions upon senior officers of
the Argentine military. Stating that the measures taken by the Argentine
authorities were necessary to prevent "vast and international" contraband, the.
Argentine note states that they could largely be avoided if the Paraguayans

would study with them measures for the suppression of such contraband. Finally,
the GOA concludes that due to the circumstances cited, the planned improvement
of the free port area would be postponed and that Paraguayan vessels passing
through Argentine rivers would be required to use Argentine pilots as "they
have been doing to the present moment." A copy of the text is.included.as

Paraguayan Reaction to.Argentine Move
The immediate Paraguayan reaction to the Argentine denunciation of the Act
of Buenos Aires was one of shock. Foreign Minister Sapena Pastor was quoted
.by Patria as saying the Argentine note was "truly surprising" and;again.repeating
the Paraguayan thesis that the Parana is an international river, that Argentine
sovereignty over the Parana is not absolute but subject to servitudes, that
undenied police jurisdiction should not serve as a base for arbitrary acts,,
and that Argentina does not have the right to suspend the Act of Buenos Aires
which assures to Paraguay "the minimum rights belonging to a mediterranean country." The press report of the Foreign Minister's remarks are transmitted,
as enclosure (5).
The'opposition political parties have not yet reacted to the most recent
Argentine note. It is of interest, however, that their earlier reaction to
the Argentine note of June 15 was largely to accept the Argentine allegations
of contraband at face value and to use.the incident as one more example of
corruption within the government. Both the Levi-Liberals La Libertad and the
Febreristas El Pueblo pointed editorial fingers at the State Fleet for
jeopardizing the interests of the nation. In view of the tone of the recent
Argentine note, however, it is expected that they probably will rally as
Paraguayans to the national cause, or. at least temper their criticism of the.
administration.
Congressional leaders Dr. J. Augusto SALDIVAR and Dr. Luis Maria ARGA iA
of the governing Colorado Party have published a resolution which they will
present to a special session of the National Congress July 28 "emphatically
condemning" the attitude of the Argentines.
A Foreign Ministry source claims that student demonstrations have been
avoided, and that the. GOP has prevented the stoning of the Argentine Embassy,
and stopped public rallies. However, a student rally has been announced for
July 27 at which Dr. Emilio SAGUIER Aceval will speak (see below).
Immediate Consequences of the Argentine Move
The suspension of the Act of Buenos Aires will have practically no
immediate economic effect on Paraguayan river commerce. As of the present time
Paraguayan-vessels passing through those parts of the Parana under Argentine
jurisdiction are still piloted by-Argentine river pilots and the facilities of
the Paraguayan free port area in Buenos Aires reportedly have not yet been

improved. This does not discount the fact, however, that Paraguay stood to
save in the future a considerable sum annually in fees paid to Argentine
river pilots had the Act been fully, implemented; nor does it deny that improved
transshipment facilities in. Buenos Aires are badly needed.
The immediate significance of the Argentine action is political,
especially as it effects internal Paraguayan politics. Foreign Minister Rail:
SAPENA Pastor has been the object of cons.idorable criticism in regard to the
unsuccessful conclusion of the negotiations which preceded the implementing
regulations of the Act of Buenos Aires. Much of this criticism has come from
Dr. Emilio Saguier Aceval,. editor of the two semi-official tabloids El Pais
and La Tarde, and known to harbor aspirations for Sapena Pastor's job.
