We received your 2 October 2010 facsimile on 4 October 2010 appealing
our 30 September 2010 final response to your Freedom of Information Act
(FOIA) request for "a database listing of all the FOIA requesters from FY 2008
� present that you have classified as 'news media." Specifically, you appealed
our determination that we could not accept your request because the FOIA
does not require federal agencies to create a record, collect information,
conduct research, or analyze data.
P1ease be advised that since we did not provide you with appeal rights, we cannot
