We received your 2 October 2010 facsimile on 4 October 2010 appealing our 30
September 2010 final response to your Freedom of Information Act (FOIA) request for "a
database listing of all the FOIA requesters from FY 2008 � present that you have classified
as 'commercial.' Specifically, you appealed our determination that we could not accept
your request because the FOIA does not require federal agencies to create a record, collect
information, conduct research, or analyze data.
Please be advised that since we did not provide you with appeal rights, we cannot
accept your appeal. However, as you know, you are free to submit a new FOIA request at
any time.
