II. (U) Summary of Investigative Actions
1. --(S79LI4F-)-On 14 September 2017, OIG received information via OIG website alleging
Industrial Contractor with assitznec to
utilized his Agency Internet Network (AIN) access from his workstation to run his
personal business (unrelated to his contract duties) while also charging the government for billable hours.
The Complainant stated that several members of his team have approached him with similar concerns

2. (Ulla-Pr-Wit On 22 September 2017, OIG initiated an investigation into this matter. This
matter was investigated as potential violation of Federal criminal statute 18 U.S.C. �287, False, Fictitious,
or Fraudulent Claims; and Agency Regulation (AR) 12-14, Limited Personal Use of Government Office
Equipment Technology Systems. The OIG's investigation of this matter included interviews of Agency
personnel, review of relevant Agency records, and cable reviews.
III. (U) Findings
3. (Ullet43B) The OIG's investigation of the allegation of a violation of AR 12-14 and 18
U.S.C. �287 was substantiated when OIG found evidence he billednhours to the Agency for work not
related to his contract. On 28 December 2018, the Department of Justice was briefed, which declined
prosecution in favor of administrative actions.

be referred to the Directorate of Operations and Office of the
Procurement Executive (OPE) for action to recover the hours of time he billed to the contract
