Donna R. Newman, Bsq., on behalf of Mr. Padilla as his Next Friend, respectfully requests
that this Comet issue a Writ of Habeas Corps.
2. A Petition for Writ of Habeas Corpus was previously filed with this Court. This amended
Petition is submitted pursuant to 28 U.S.C. 1 2242 and Rule 15 of the Rend Rules of Civil
Procedure.

Respondents at the Consolidated Naval Brig in Charleston, South Carolina.
4. Petitioner Donna R. Newman is an attorney duly admitted to practice law in the Southern
DistriCt of New York. On or about May 15, 2002, Petitioner Donna R. Newman was
assigned to represent Petitioner Jose Padilla by Order ofthe Honorable Chiefludge Michael
B. Multasey.
5. Petitioner Donna R. Newmen, seeks :elides "Next Friend" pursuant to the requirements of
Nbihnorgi,Adanal& 495 U.S. 149(1990) add& requires a "next friend" to provide an
adequate explanation whylhe real party in action cannot appear on his own WINK to be trody
dedicated to the beet interests of the person on whose behalf*. seeks to litipte and for the
"next friend" to demonstrate some significant relationship with the real party in Want.
6. In the instant matter, Petitioner Jose Padilla cannot appear because he is detained in the
Consolidated Naval Brig in Charleston, South Carolina. Petitioner lose Padilla cannot sign
and verify the Amended Petition as counsel has been denied access to him by the
Respondents. Petitioner Jose Padilla is not permitted to send or receive maiL Respondents
have not permitted Petitioner Jose Padilla to communicate with anyone else including
