Dear Mr. Ryan:
This letter outlines the procedures Which we have
discussed concerning future requests for review of in-
formation in CIA records concerning subjects of OSI
investigation.
All requests for information will come from the
Director, OSI, or his special assistant, Mr. Sullivan,
and be directed to the General Counsel, CIA, Attn.:.
These requests will be limited to
individuals who are subjects of investigation for viola-
tion of U.S. law. OSI will supply an outline of the
allegations against a subject and provide a brief bio-
graphic sketch. At a minimum, sufficient information
will be provided to allow traces to be run. This
normally should include the full name, date and place
of birth.
Upon receipt of a request, the Office of General
Counsel will acknowledge the request and direct that the
records of the Directorate of Operations (DO) and the
Office of Security (OS) be searched for any information
on the subject of the request. OSI will be informed
promptly whether or not CIA has any information. All
records on the subject will then be reviewed by more
senior officers for information specifically requested
by OSI, or for the following:

1. All information concerning the subject's
activities from 1933 to 1945 which would indi-
cate membership in the Nazi party, SS, Waffen
SS or quisling governments established under
German occupation.
2. All information concerning the subject's
immigration to the U.S. and naturalization.
Following this review, two files will be constructed for
OSI review, one containing DO information, the other OS
information. These files will consist of all documents or
portions of documents whicThcontain information respon-
sive to the OSI request.
These files then will be reviewed by the OSI investi-
gator or trial attorney assigned to the case at CIA Head-
quarters. OSI will request clearances for these individ-
uals prior to the review. During the review, CIA will
inform OSI of any association the subject may have had
with CIA. The OSI investigator or trial attorney will
indicate that he has reviewed each document in the file
by placing his initials and the date near the document
number. OSI reviewers may take notes during their review,
but all notes will be submitted to CIA for sanitization
and/or classification. CIA will then promptly forward the
notes to OSI.
All requests for third Agency documents will be ini-
tiated by OSI to the originating agency. In the event that
the originating agency cannot locate the document, CIA will
forward a copy to that Agency.
All requests for use of CIA documents will be made to
the Office of General Counsel, well in advance of their
intended use, and will specify the use intended for each
document. CIA will respond to such requests in a timely
manner and, where it objects to the intended use of a
document, state its basis for objection. All questions
concerning possible exposure of classified CIA information
and protective measures to be taken will be resolved at the
earliest opportunity.
