Re: FOIA Request for Records Regarding Contractor Violent Crimes
Dear FOIA Officer:
Pursuant to the Freedom of Information Act, 5 U.S.C. � 552, the UNROW Human Rights Impact
Litigation Clinic at the Washington College of Law, American University, requests any and all
records in any form or format (including e-mail, even if currently only maintained on back-up
media) from October 2001 onwards relating to, involving, describing or touching upon any and
all investigations of or inquiries into civilian contractors, including individuals, entities, or
individuals or entities working for, employed by or contracted by such entities, involving violent
crimes Or potentially criminal activity occurring in Iraq and/or Afghanistan, and/or any
subsequent referrals of such investigations or inquiries to any other agency, subsidiary,
department, office or official.
We seek records in any form or format (specifically including e-mail, even if currently only
maintained on back-up media), including but not limited to any records generated pursuant to the
December 5, 2007 "Memorandum of Agreement Between the Department of Defense and the
Department of State on USG Private Security Contractors" (M0A).These include, but are not
limited to:
1. All notifications or investigations of a "serious incident involving a PSC" generated by
the U.S. Embassy Baghdad or CONOC, conveyed to MNF-I, RSO, or the Government of
Iraq, as described in Section VII, paragraph 2 of the MOA;
2. Any records regarding any proposals for or the expenditure of "condolence payments" to
the families of Iraqi nationals, per Section VII of the MOA;

c. and the final disposition or referral of these claims.
Further, Ave -seek any similar records generated after October 2001, in any form or fon iat,
regarding, touching upon, describing or relating to contractors accused of, suspected of, or
involved in-Violent crimes or potentially criminal activity in Afghanistan or Iraq.
Finally, we seek record� regarding the referral of investigations, cases, or claims to the U.S.
Department: of Justice, or any other agency, department, office, agency component,
subsidiary Or official. These include, but are not limited to, records relating to:
d. offices. and personnel involved in the decision to refer the investigations, cases or
claitnS,
e. the decision to refer the cases, investigations or claims.
The UNROW Clinic is part of an educational institution � American University's Washington
College of Law � and ,this request is Made for a scholarly purpose and not for commercial use.
Accordingly, .there should be� no search fees associated with this request. As to any copy fees,
the Clinic is -milling to pay any reasonable feeS. We reserve, however, the right to request a
general public interest fee waiver for information responsive to the request located and disclosed.
If you deny all or any part of this request, you are required, pursuant to 5 U.S.C. �552(b),
effective December 31, 2007, to specify each exemption in connection with each item of
information withheld which you believe justifies your refusal to release the information.
