He is appealing CIA's refusal to process his Mandatory Declassification Request and the subsequent denial of appeal rights. Your case number, EOM-2010-00945 was assigned to Mr. McClanahan's request which pertains to an attempt to obtain a listing of CIA records of the Medical and Psychological Analysis Center and its predecessor bodies. According to the ISCAP bylaws, his request now falls under the jurisdiction of the ISCAP. Attached are a PDF of the formal material request letter for the document and any ancillary information that was mailed to Mr. Lambert as well as a PDF copy of Mr. McClanahan's appeal to ISCAP. As we recently communicated to you, Executive Order 13526, "Classified National Security Information" (the Order), states that the mandatory declassification review (MDR) provisions of the Order shall not apply to MDR requests submitted to elements of the Intelligence Community by "a person other than an individual as that term is defined by 5 U.S.C. 522a(a)(2)." According to 5 U.S.C. 522a(a)(2), "the term 'individual' means a citizen of the United States or an alien lawfully admitted for permanent residence." In our letter of November 22, 2010, we asked that you provide proof that you meet one of these criteria. In response, you communicated that you are currently seeking permanent resident status. Therefore, as Executive Secretary, I will extend the deadline previously discussed for furnishing residency status by an additional 90 days. Please provide the ISCAP with proof of your permanent resident status by May 18, 2011 so that the ISCAP can continue to consider your appeal.
