SUBJECT: (U//F U ) Particularly Serious Problem
1. (u/rrtyte,) I have become aware of a development
related to the Agency's counterterrorism effort that I must
report to you as a "particularly serious problem" within
the meaning of Section 17 of the CIA Act.
2. 4,4 /NF) In a memorandum dated 26 June 2003, the (b)(3)
Associate Deputy Director for Operations (ADDO) notified me of
the death on 21 June 2003 of Afghan detainee Abdul Wali under
circumstances that were at that time not clear, but gave rise to
concern. The ADDO asked that the Office of Inspector General
(OIG) investigate the matter, which we have been doing.
They report
there is reason to believe an Agency contractor may
have engaged in criminal assault or torture of the detainee
prior to his death. I am filing a crimes report with the
Department of Justice.
3. (U//F U ) In my judgment, this development, as
reported to me, constitutes an abuse that triggers my statutory
obligation to make an immediate, formal report to you. In turn,
you, as DCI, are required to notify the Congressional
intelligence committees within seven days. I recommend that
such notification include mention of the facts that the OIG is
investigating this matter and a crimes report is being filed.
4. (U) I am sending a copy of this memorandum to the
DDCI. I will leave to your office any further distribution of
