Dear Mr. Covucci:
This is a final response to your 26 May 2015 Freedom of Information Act (FOIA)
request, received in the office of the Information and Privacy Coordinator on 27 May
2015, for what we have interpreted as a request for pornographic material Osama Bin
Laden had in his possession at the time of his death. We have assigned your request
the reference number above. Please use this number when corresponding so that we can
identify it easily.
With regard to the pornographic material Osama Bin Laden had in his possession
at the time of his death, responsive records, should they exist, would be contained in
operational files. The CIA Information Act, 50 U.S.C. � 431, as amended, exempts CIA
operational files from the search, review, publication, and disclosure requirements of the
FOIA. To the extent that this material exists, the CIA would be prohibited by 18 USC
Section 1461 from mailing obscene matter.
Regarding the remainder of your request, the FOIA was enacted to provide a
means for the general public to access government records. Under the provisions of the
FOIA, federal agencies are not required to answer questions posed as FOIA requests.
Since your request does not constitute a request for records, we must decline to process it.
