(Uthir14344) National Security Archive Submits Numerous Requests
(U//kfttel) Among the two dozen requests received this week from the National Security Archive are a request for
a copy of a 1964 National Intelligence Estimate (NIE) 4-2-64, titled "Prospects for Proliferation of Nuclear
Weapons Over the Next Decade," and a request for "National Intelligence Council or other Intelligence Community
documents produced in October 1993 that warned that conflict threatened 1.5 million people in Rwanda." The
Archive also continues to submit requests regarding Colombia, including one for information pertaining to "the
massacre of anywhere from 11 to 30 people in Barrancabermeja, Colombia, in May 1998," and "the massacre of
civilians at Puerto Alvira, Colombia by paramilitary forces in June 1997."

(U//Aft70) A requester with the Center for International Development at Harvard University asked for "copies of
cables between the United States Embassy in Russia and the CIA between 1992 and 1998 with any relevance to
United States overseas development assistance, particularly the Freedom Support Act."
� The FOIA case officer advised the requester that because his request pertains to relations between the US
Government and foreign governments, he should contact the Department of State for further assistance.

(U//AdinTf)) A requester who claims to be affiliated with the University of Texas at Austin requested information on
"the November 1975 SchizoCulture Conference at Columbia University, organized by Sylvere Lotringer. The
conference was an international affair concerned with schizophrenia and revolutionary politics."

(U//TO) External Referral Working Group Discusses Changes to EO 12958
(U/MM The External Referral Working Group (ERWG) held its monthly meeting in Washington, DC, on 21
February 2001. The Group grappled with a host of complex declassification issues including recommendations for
changes to EO 12958, which was issued by the Clinton administration and likely will be replaced by the Bush
administration.
� The ERWG was formed in 1996 to coordinate declassffication policies, standards, and procedures among
the agencies affected by President Clinton's Executive Order 12958 on Classified National Security
Information. Today over 40 declassification programs representing more than 25 federal agencies
participate in ERWG programs.
(UHAIU0) From the Archives: CIA Constitutional Issue in 1952
(U/L4.1kiE7 In 1952, Larry Houston, the Agency's General Counsel, put Agency responses to requests for
information from Congress into a legal context in a memorandum to the DCI titled "Refusal by Executives to
Provide Information to Congress." In the memorandum, which was recently reviewed by the DCI Team at the OIM
Declassification Center, the General Counsel stated, "the President and the heads of executive departments have on
occasion refused, for reasons of public interest, to furnish information requested by Congress or Congressional
committees." Noting that at that time Congress had never "taken steps to compel compliance after the executive has
refused to furnish information," he explains, "this stems from the fundamental doctrine of the separation of powers
among the three branches of government. The Constitution lodges the executive power in the President. The
authority of each head of department is part and parcel of the executive power of the President." He then noted that
"it follows that Congress cannot, under the Constitution, compel heads of departments to make public what the
President desires to keep secret in the public interest ... The executive's position is by history and precedent
particularly strong where secrets of state are involved..."
