This is a final response to your 12 July 2007 Freedom of Information Act (FOIA)
request, received 12 July 2007, for copies of "[a]ll documents created between 1953 and
1985 related in whole or in part to Reef Swiatlo." We have assigned your request the
reference number above.
In accordance with section 3.6(a) of Executive Order 12958, as amended, the CIA
can neither confirm nor deny the existence or nonexistence of records responsive to your
request. The fact of the existence or nonexistence of requested records is properly
classified and is intelligence sources and methods� information that is protected from
disclosure by section 6 of the CIA Act of 1949, as amended. Therefore, the Agency has
denied your request pursuant to FOIA exemptions (b)(1) and (b)(3).
For your information, we received another FOIA request for records concerning the
subject of your request that was processed up through the appellate level. The
determination that we can neither confirm nor deny the existence or nonexistence of
records responsive to the request was upheld at the appellate level on 10 May 2007.
