Dear Mr. Orlowski:
This responds to your 7 January 2007 letter appealing our 6 December 2006 response your
Freedom of Information Act request for records about the interrogation and deposition of Joseph
Swiatlo, a member of the Polish Secret Police who defected in 1953, transcripts of his debriefing,
and any documents relating to the activities and crimes of the NKD in post-WWII Poland and their
control over the Polish Communist government. Specifically, you appealed our determination that
we can neither confirm nor deny the existence or nonexistence of records responsive to your
request on the basis of Freedom of Information Act exemptions (b)(1) and (b)(3).
The Agency Release Panel has considered your appeal and has sustained its determination
that the Agency can neither confirm nor deny the existence or nonexistence of records responsive
to your request on the basis of Freedom of Information Act exemptions (b)(1) and (b)(3).
Therefore, in accordance with Agency regulations, the Agency Release Panel has denied your
appeal. These Agency regulations are set forth in part 1900 of title 32 of the Code of Federal
Regulations.
In accordance with the provisions of the Freedom of Information Act, you have the right to
seek judicial review of this determination in a United States district court.
