We are responding to your 4 July 2005 letter in which you appeal our
1 June 2005 response to your Freedom of Information Act request for records on Jozef
Swiatlo, who was one of the most important functionaries of the Polish Ministry of
Public Security. Specifically, you are appealing our determination to neither confirm
nor deny the existence or nonexistence of records pertaining to Mr. Swiatlo, beyond
the material provided in our 1 June 2005 response.
The Agency Release Panel, having considered your appeal, has sustained the
determination that the Agency can neither confirm nor deny the existence or
nonexistence of records responsive to your request on the basis of Freedom of
Information Act exemptions (b)(1) and (b)(3). Therefore, in accordance with Agency
regulations, the Agency Release Panel has denied your appeal. These Agency
regulations are set forth in part 1900 of title 32 of the Code of Federal Regulations.
In accordance with the provisions of the Freedom of Information Act, you have
the right to seek judicial review of this determination in a United States district
court.
