Dear Dr. Regis:
This is further to our 22 December 2004 letter regarding your
10 November 2004 Freedom of Information Act (FOIA) request for:
"a list of all CIA documents pertaining to
OPERATION TAILWIND, 11-14 September 1970."
We accept your request; it will be processed in accordance with the
FOIA, 5 United States Code (U.S.C.) � 552, as amended, and the CIA
Information Act, 50 U.S.C. � 431. Unless you object, we will limit our search to
CIA records existing through the date of this acceptance letter.
Based on the information provided in your letter, we determined that
your request falls into the "educational and non-commercial scientific
institution" fee category, which means that you will be required to pay only the
cost of reproducing released records. You will be assessed for document copies
at the rate of ten cents per page for pages in excess of the first 100, to which
you are entitled free. We note your request to be notified in advance should
costs associated with this request exceed $50.

The large number of FOIA requests the CIA receives has created
unavoidable processing delays making it unlikely that we can respond within
the 20 working days the FOIA requires. You have the right to consider our
honest appraisal as a denial of your request and you may appeal to the Agency
Release Panel. A more practical approach would permit us to continue
processing your request and respond to you as soon as we can. You will retain
your appeal rights and, once you receive the results of our search, can appeal
at that time if you wish. We will proceed on that basis unless you tell us you
object.
