Pursuant to the Freedom of Information Act (FOIA), 5 U.S.C. Section 552, et
sea. (as amended), I hereby request disclosure of the documents described on the
last page of this letter for inspection and possible copying. -
If you regard any of these documents as exempt from the FOIA's disclosure
requirements, I request that you nonetheless exercise your discretion to disclose
them. In this connection I note that you are required under the FOIA to release any
reasonably segregable nonexempt portions of documents containing information you
regard as exempt. Section 552(b). To permit an intelligent, informed decision
whether or not to file an administrative appeal of any denial decision, you are also
requested to describe withheld records (or portions thereof) and explain the logical
and factual basis for exemption claims. See Mead Data Central, Inc. v. Department
of the Air Force, 566 F.2d 242, 251 (D.C. Cir., 1977).
This request is made on behalf of the National Security Archive, a nonprofit
public interest research institute and library located in Washington, D.C. The
Archive is organized and operated as a divison of the Fund For Peace, Inc., a tax-
exempt nonprofit corporation. The Archive's purpose is to enrich public policy
debate by making available records pertaining to important issues of major public
concern in the areas of foreign, defense, intelligence, and international economic
policy.
� Documents obtained by the Archive, including the records requested in this .
letter, are carefully analyzed, indexed and organized into document sets inr_the
Archive's collection and published. Document sets are available for inspection ancg
copying by scholars, journalists, members of Congress and Congressional staffs, c-.-)
present and former public officials, other public interest organizations, and the
general public at the Archive's Washington office. Information in the documents
disseminated across the country through distribution of comprehensive document
int_ices to university and other research libraries and through the Archive's Crl

As a staff mcmbcr of the Archivc, I have bccn assigncd to conduct research on
thc subject of this request. I am working as part of a rcsc.arch tcam which includcs
cxperts on this subjcct with a widc varicty of educational and professional
backgrounds relating to foreign affairs, cid-case., intelligcnce and international
economic policy. Membcrs of the team have conducted an extensive litcraturc
scarch at the Library of Congress and spccialized rcscarch libraries and have
determined that the requested materials arc necessary to our research..
I further ask that yo.0 waive all fees in connection with this request In
National Security Archive v. U.S. Dcoartmcnt of Defense, 880 Fid 1381 (D.C. Cir.
1989), cert. denied March 19, 1990, the D.C. Circuit held that thc Archive is
entitled to a waiver of all search and rcvicw fccs under thc FOIA as a
"reprcsentativc of the news mcdia". Id. at 1387. The appeals court also determined
that Archivc requests made in furtherance of its publication and related activities
arc not for a "commcrcial use.' id. at 1388.
� This request also qualifies for a waivcr of duplication fccs because
disclosure of thc information in the requested documents is in the public interest
as it is likely to contribute significantly to public understanding of thc operations
or activitics of the government Scc 5 U.S.0 Section 552(a)(4)(A)(iii). Should you
decline to waive or reduce all duplication fees, we arc prepared to pay normal
reproduction costs if I decided to copy the records produccd. Our willingness to
pay such fees is subject to our rights to appeal and litigate the fcc waiver question.
I furthcr ask that if you decline to waive duplication fees that you set forth your
specific reasons for doing so in writing and that you obtain our authorization
before incurring costs in cxccss'of 5100.

Subject of Request:
Press reports and conversations with Polish United Workers Party -
officials indicate that during 1980 and 1981, when the Solidarity trade
union was active, the Soviet Union and Warsaw Pact were pressuring Polish -
officials to crack down on Solidarity. Such pressures included threats ofl
military intervention, especially during Augutt, September and December
1980, and March, April and the late fall and early winter of 1981.
I am requesting any and all documents relating in whole or in-part.to-
movements of Soviet or Warsaw Pact troops or military equipment inside or,
near Poland during the years 1980 and 1981. Also any and all documents 1
discussing Soviet intentions, policy statements or conversations relating ti
a possible Soviet or Warsaw Pact invasion of Poland and Polish responses.
Such documents should include but not be limited to raw or finished
intelligence reports from field agents in the Soviet Union, Poland and othel
Warsaw Pact nations, reports or discussions of satellite information,
intercepts of conversations of foreign officials and cables, reports,
memoranda and intelligence estimates, including Special National
Intelligence Estimates, prepared by U.S. analysts or operatives.
I am also requesting any and all documents relating in whole or in pars
to United States reaction to the threat of a possible Soviet or Warsaw Pact4
intervention in Poland in 1980 or 1981. These documents should include but-:
not be limited to cables, reports, directives, agendas and minutes of
meetings, after action reports, briefings, briefing books, memoranda, notes.
and orders.

NOTE: This request merits a waiver of all fees because any documents yieldec
by it will contribute significantly to public understanding of U.S. 1
government operations and activities and will be published in an upcoming
document set. As a representative of the news media, I agree to pay any
legally assessable copying costs less than $100. If the fees generated by 1
this request will be greater than $100, I request that you advise me of thal
before incurring such costs.
