Dear Mr. Wright,
I am writing this letter to inquire about the
status of the Freedom of Information Act requests cited
above. In all of these cases, your agency denied the
National Security Archive a fee waiver on the grounds
that it was making these requests for commercial
purposes. I appealed your fee waiver denials for these
requests in a series of letters during October 1990.
Since then the National Security Archive and your agency
have reached an understanding whereby the CIA more or
less routinely grants the Archive a fee waiver as a
representative of the media. For its part, the Archive
has agreed to pay legally assessable copying fees. I
request that you do the same with the requests at issue,
that is, promptly grant the Archive a fee waiver and
begin to process these requests, if you have not done so
already.
These requests deserve a waiver of all fees because
the information that they would yield on the Berlin
Crisis would promote better public understanding of U.S.
government operations. They would show how the U.S.
intelligence community reported on and analyzed a major
foreign policy problem during a crucial period in the
history of the Cold War. In the event that you deny the
Archive a full waiver for these requests, we agree to
pay any legally assessable copying fees.
