STIPULATION
Through 1969, Mr. Eugenio Martinez undertook maritime assignments
for the Central Intelligence Agency directed against a country in the Caribbean.
These assignments included intelligence collection and harassment operations
against this country. Associated therewith, were some operations that were
designed to cause the destruction of the property of that country. The assign-
ments also included the ferrying of individuals to and from that country,
including bringing aliens into the United States through non-public means.
In connection with these assignments, he was authorized to possess certain
unregistered firearms and to transport such firearms and ammunition in
"foreign commerce" without a license against that country. This authorization
included carrying concealed weapons. The authorization was subject to the
understanding that Mr. Martinez was accountable to the Central Intelligence
Agency for these weapons and they were to be transported only in connection
with these foreign assignments.
With regard to Mr. Martinez' salary, he was paid by a legitimate cover
instrumentality of the Central Intelligence Agency. Accordingly, he reported
his income as derived from that cover instrument for Federal tax purposes.
From 1970 until the end of his employment with the Central Intelligence
Agency in 1972, Mr. Martinez was on a retainer with the Central Intelligence
Agency. During this period, Mr. Martinez served as a casual informant
providing intelligence information as a result of his contacts with individuals
in the Cuban exile community in Miami, Florida.
All the above activities were approved and authorized by the Central
Intelligence Agency. The Central Intelligence Agency had approval for these
activities from the appropriately authorized body designated by the National
Security Council pursuant to the National Security Act of 1947 (Title 50,
United States Code), as amended.
