MEMORANDUM FOR THE RECORD
SUBJECT: Eugenio R. Martinez
; �
1. Today, Eugenio R. Martinez telephoned me from "
Miami, Florida, indicating that he had received a copy of my
18 April 1974 letter to his attorney, Daniel E. Schultz. The
letter authorized Mr. Martinez to discuss with Mr. Schultz
his, Martinez', prior activities for the Agency.
2. Mr. Martinez said he was concerned about answering
some of Mr. Schultz' specific questions. He said Mr. Schultz
planned to be in Miami in a few days to go over this with him.
Mr. Martinez stated that he did not want to give any information
to Mr. Schultz which might be used publicly and harm employees
of the Agency or the United States. I told Mr. Martinez that
Mr. Schultz is under an obligation to the Government, in writing,
not to use any information publicly without prior clearance from
the Agency. Furthermore, I said Mr. Schultz, as a lawyer,
has an obligation to his client not to disclose any information
without his client's consent. I told Mr. Martinez that his.lawyer
is entitled to a reasonable picture of his client's prior activities
in order to determine how best to handle his case and that Mr.
Martinez should consider very carefully the requests from his
lawyer. I iterated that as far as the Agency was concerned he,
Mr. Martinez, was authorized to furnish this information to
Mr. Schultz.
3. I told Mr. Martinez that I would discuss the above
matter with Mr. Schultz. Mr. Martinez said he appreciated
my talking with him, and I thanked him for his efforts to
preserve security.

4. I then talked to Mr. Schultz, giving him the substance
of my conversation with Mr. Martinez. I said that earlier I had -
discussed this matter with Mr. William Merrill, Special Prosecu-
tor's office. Mr. Merrill had indicated that if there were any
classified matters which were relevant he was sure that some
method could be worked out to get them to the jury, possibly
involving stipulations or furnishing them to the jury only under
protective order or some other method. Mr. Schultz thanked
me for calling about this, and I assured him again that we wanted
to cooperate in every appropriate way with him and Mr. Martinez.
