Dear Mr. Mokoena:
Pursuant to the recent District of Columbia District Court
decision in National Security Archive v. Central Intelligence
Agency, we are initiating the processing of National Security
Archive cases held in abeyance pending resolution of fee
issues. Your request, formerly F87-1218, has been assigned
reference number F90-1590 for identification and tracking
purposes.
Specifically, you are requesting records pertaining to the
following:
"(a) the Soviet Union and Cuban intervention in Angola
from 1974 to date;"
"(b) the United States government activities and
response to Soviet and Cuban intervention in Angola from
1974 to date;" and
"(c) the South African government intervention in
Angola from 1974 to date."
Concerning your request for a waiver of fees, the Freedom
of Information Reform Act, 50 U.S.C. �552(a)(4)(A)(iii),
specifically provides that "[d]ocuments shall be furnished
without any charge or at a charge reduced below the fees
established under clause (ii) if disclosure of the information
is in the public interest because it is likely to contribute
significantly to public understanding of the operations or
activities of the [United States] government and is not
primarily in the commercial interest of the requester."
Topics (a) and (c) of your request clearly do not meet the
criteria established for a waiver of fees under the FOI Reform
Act. Inasmuch as the information you seek in these portions of
your request pertains entirely to the Soviet Union, Cuba, and

Angola, it is not likely to contribute significantly to public
understanding of the operations or activities of the United
States Government. Accordingly, in this instance, your request
for a fee waiver is denied for topics (a) and (c).
With respect to topic (b), we have considered this portion
of your request against our Rules and Regulations as published
in the Federal Register, as well as relevant Department of
Justice and Office of Management and Budget guidelines, and
determined that no fees will be charged for topic (b) in this
instance.
Based on your general statement of intent to publish, you
may be eligible for categorization as "representative of the
news media" for topics (a) and (c) of your request. To
establish your eligibility in connection with this request, we
will need from you a detailed statement of your specific
publication plans for any material which might be released in
response to this particular request. As "representative of the
news media," you would be responsible only for copying costs in
excess of 100 pages of releasable documents.
No further action can be taken on this request until we
receive your reply, including your commitment to pay copying
costs for topics (a) and (c), as explained above. If we have
not received your response within 30 days of the date of this
letter, your request will be cancelled.
