Pursuant to Section 2.4 of Executive Order
12863, "President's Foreign Intelligence Advisory Board," I am
submitting this quarterly report for the third quarter of
calendar year 2006.
In accordance with guidance from the Assistant
to .the Presi~ nt for National Security Affairs dated 18 August
2006, I am sending this report to you, as the General Counsel of
the President'?s Foreign Intelligence Advisory Board, instead of
to the Chairman of the Intelligence Oversight Board. It is
provided to you in addition to the quarterly report you may
receive from the Central Intelligence Agency's (CIA or Agency)
Office of Inspector Genera.. As you know, the Executive Order
requires me to report intelligence activities that I have legal
reason to believe may be unlawful or contrary to Executive Order
or Presidential directive. Since my last report, I am aware of
four reportable items, which are reported below.
