This correspondence responds. to your 9 December 20041etter in which
'you appealed the 4 November 2004 determination of this agency regarding
your 26 October 2004 Freedom of Information Act (FOIA) request for "the
June 2004 CIA Inspector General's Report discussing the events of
September 11, 2001." Specifically, you appealed our determination to protect
the requested information in its entirety on the basis of FOIA exemptions
~)(1)~ ro)(3), and ro)(5)?
In considering your appeal, the Agency Release Panel has determined
that Agency officials erroneously processed your FOIA request and
mistakenly presumed the draft report was the final version. They applied the
FOIA's exemptions to protect the information in the draft report as if it was
final, and, thus, responsive to your FOIA request. Because the Agency's Office
of Inspector General has not yet produced a final report, no documents
responsive to your FOIA request exist. For these reasons, we are closing your
9 December 2004 appeal of our determinations regarding the application of
FOIA exemptions (b)(1), (b)(3), and (b)(5). You may appeal the determination
that no documents responsive to your FOIA request exist by submitting an
appeal to the Agency Release Panel, in my care, within 45 days from the date
of this letter.
