On 22 March 2006 we sent you a letter citing F-2004-00077 as the reference
number for this appeal. The correct reference number is noted above. Please accept
our apology for any confusion this might have caused. As such, this responds to your
8 March 2006 letter appealing our 2 March 2006 response to your Freedom of
Information Act (FOIA) request for, "Office of Medical Services (OMS)/Oral History
Program, Statement by John R. Tietjen, MD (Director, OMS, 1947-1974)."
Specifically, you appealed our determination to deny you access to this item in
its entirety on the basis of Freedom of Information Act exemptions (b)(3) and (b)(5).
Your appeal has been accepted and arrangements will be made for its
consideration by the appropriate members of the Agency Release Panel. You will be
advised of the determinations made.
In order to afford requesters the most equitable treatment possible, we have
adopted the policy of handling appeals on a first-received, first-out basis. At the
present time, our workload consists of approximately 200 appeals awaiting completion.
In view of this, some delay in our reply must be expected, but I can assure you that
every reasonable effort will be made to complete a response as soon as possible.
