(b)(3) (b)(6) ?M5 NOV -2 AN 11: 39 October 20, 2005 Freedom of Information Act Appeals Officer Thru: Information and Privacy Coordinator Central Intelligence Agency Washington DC 20505 APPROVED FOR RELEASE^ DATE: 08-25-2010 FREEDOM OF INFORMATION ACT APPEAL Dear Sir or Madam: I hereby appeal a portion of the decision in F-2006-00005, the initial denial of which was dated October 14, 2005. I requested some specified records concerning the Kryptos Art Sculpture, and I received 15 pages of materials supplied to a previous requester. I limit my appeal to item number 3 "a copy of the x-ray reports from x-raying of the granite slabs making up the Kryptos sculpture; the x-rays were performed on the granite at the time of installation" - and I question the sufficiency of the search for these materials. The mere fact that records extent from a previous request is no indicator that the request was worded in a way that was likely to generate records. It is well known that the agency takes an extremely narrow interpretation of requester language, and a poorly worded request would tend to exclude responsive records. My request should not be limited to the prior requester's knowledge of CIA records and ability to describe what he or she was asking for. I believe that it is quite likely that reports and photographs of the x-rays described above do exist and can be retrieved. Therefore I appeal the decision with regard to item number 3 but I do not appeal the determination for the other items requested. Sincerely,
